Використання спеціальних знань при розслідуванні злочинів, учинених в умовах воєнного стану

Abstract

Розглянуто окремі питання використання спеціальних знань у формі залучення спеціаліста до проведення слідчих (розшукових) дій під час розслідування злочинів, учинених в умовах воєнного стану. Визначено спеціалістів, що беруть участь у розслідуванні визначеної категорії кримінальних проваджень, зазначено основні дії, що ними виконуються та зосереджено увагу на об’єктах, що вилучаються під час огляду місця події. Наведено перелік експертиз, що здебільшого призначаються під час розслідування кримінальних правопорушень, вчинених в умовах воєнного часу та визначено об’єкти та предмет їх дослідження. Separate issues of the use of special knowledge in the form of involving a specialist in conducting investigative (research) actions during the investigation of crimes committed under martial law were considered. Specialists participating in the investigation of a certain category of criminal proceedings have been identified: explosives technicians, ballistics experts, weapons experts, rocket and aviation experts, gunners, mechanics, etc. In addition, firefighters or employees of the State Emergency Service may be involved to inspect the site of the fire, dog handlers with service dogs, forensic medical experts or doctors to examine corpses, biologists to take DNA samples, etc. The main actions performed by them are specified and attention is focused on the objects that are removed during the inspection of the scene of the incident. The list of examinations that are most often prescribed in the investigation of criminal offenses committed under martial law is given, namely: weapons and traces and circumstances of their use; materials, substances and products; explosive engineering, namely: examination of explosive devices, explosive substances and explosion products; engineering and technical, namely the following types: engineering and transport (automotive engineering, railway and transport), road engineering, construction engineering, construction evaluation, fire engineering, environmental engineering; commodity science: machines, equipment, raw materials and consumer goods; transport and commodity science; military property, equipment and weapons; ecological; military; forensic medicine; molecular genetic, etc. The objects to be investigated and the main issues to be resolved during the specified examinations are defined.
