Напрями підвищення ефективності інституційного механізму забезпечення прав і свобод внутрішньо переміщених осіб в Україні

Abstract

У статті виокремлено й проаналізовано перспективні напрями підвищення ефективності інституційного механізму забезпечення прав і свобод внутрішньо переміщених осіб в Україні. До основних проблем, пов’язаних із належним забезпеченням прав і свобод людини в умовах воєнного стану, віднесено: а) загрози для безпеки внутрішньо переміщених осіб; б) погіршення умов проживання, зокрема в пунктах тимчасового перебування; в) відсутність належної можливості для реалізації законних прав і свобод; г) складність легалізації правового статусу й доступу до адміністративних послуг; д) дискримінація і сегрегація в нових місцях перебування; е) погіршений стан психічного і фізичного здоров’я внутрішньо переміщених осіб. Зроблено висновок, що ефективність механізму захисту прав і свобод внутрішньо переміщених осіб в Україні визначається здатністю цього механізму забезпечити дієвий захист відповідних благ від порушень, а також своєчасне відновлення порушених прав з компенсацією завданих збитків. The article is devoted to the identification and analysis of promising areas for improving the efficiency of the institutional mechanism for ensuring the rights and freedoms of internally displaced persons in Ukraine. The main problems related to the proper provision of human rights and freedoms under martial law include: a) threats to the security of internally displaced persons; b) deterioration of living conditions, in particular in temporary accommodation centers; c) lack of proper opportunities to exercise legal rights and freedoms; d) difficulties in legalizing legal status and access to administrative services; e) discrimination and segregation in new places of residence; f) deterioration of the mental and physical health of internally displaced persons. In the regulatory and legal area of enhancing the effectiveness of the institutional mechanism for protecting the rights and freedoms of internally displaced persons, it is proposed to take into account: a) an open list of rights and freedoms guaranteed by the State; b) amendments and additions to national legislation with a view to unifying the provisions on the status of internally displaced persons; c) clear consolidation of the powers of public administration bodies in terms of guaranteeing and ensuring the rights and freedoms of internally displaced persons. In the organizational direction, the following is proposed: a) systematization and development of the State strategy for integration of internally displaced persons in the new conditions; b) clear division of powers between the subjects of power to ensure the rights and freedoms of internally displaced persons; c) involvement of the capacities of non-state institutions to ensure the rights and freedoms of such persons; d) gradual increase of the role of non-state institutions (local selfgovernment bodies) to ensure the rights and freedoms of internally displaced persons in the post-war period. It is concluded that the effectiveness of the mechanism for protecting the rights and freedoms of internally displaced persons in Ukraine is determined by the ability of this mechanism to ensure effective protection of the relevant benefits from violations, as well as timely restoration of violated rights with compensation for damages.
