Розмежування понять «конфіденційна інформація бізнесу» та «конфіденційна інформація про фізичну особу»

Abstract

Бізнес України потребує надійного захисту своєї комерційно цінної інформації, а саме конфіденційної інформації (КІ) бізнесу чи комерційної таємниці (КТ), а також окремо конфіденційної інформації (КІ) про фізичну особу. Це особливо важливо коли мова йде про охорону КІ бізнесу або КТ, чи КІ про фізичну особу під час дії воєнного стану в Україні. Запропоновано встановити розмежування понять, «КІ бізнесу» та «КІ про фізичну особу» в Україні. Наразі бізнес в Україні сам визначає чи буде його комерційно цінна інформація КТ чи КІ, саме тому запропоновано розмежувати поняття «КІ бізнесу» та «КІ про фізичну особу». Оскільки до КІ бізнесу та КІ про фізичну особу відповідно застосовуються різні методи і засоби захисту, та нормативно-правова охорона. The business of Ukraine needs reliable protection of its commercially valuable information, namely confidential information (CI) of a business or trade secret (TS), as well as separately confidential information (CI) about an individual. This is especially important when it comes to the protection of CI of a business or TS, or CI of a natural person during martial law in Ukraine. For the present, businesses in Ukraine determine for themselves whether their commercially valuable information will be TS or CI, which is why it is proposed to distinguish between the concepts of «CI of business « and «CI about an individual». So far as different methods and means of protection and regulatory protection are applied to CI of business and CI of an individual, respectively. After the investigation of our scientific research, we can state the following: – it is necessary to distinguish between the concepts of «confidential information about an individual « and «confidential information of business», since different methods of protection against the leakage of such information and other threats must be used for each of them; – taking іnto account the presence in the legal definition of CI of a legal entity, a certain business may secrete its commercially valuable information under the label «CI» or «TS». Therefore, it is necessary to clearly distinguish the concept of «CI about an individual « and the concept of «CI of business» in order to improve the conceptual and categorical apparatus of the legislative framework of Ukraine; – CI of business is commercially valuable information in the field of business, which can negatively affect the profit of a certain enterprise in case of its leakage. Today, an entrepreneur can secret his commercially valuable information under the label «TS» or «CI» (of course, you need to add business here); – CI about an individual is information about an individual (personal data, place of work, family composition, etc.), business reputation, family secrets, and other information about an individual.
