Інноваційне розуміння дефініції контрольованої поставки наркотичних засобів, психотропних речовин, прекурсорів як різновиду контролю за вчиненням злочину

Abstract

Розглянуто інноваційний підхід до розуміння контрольованої поставки наркотичних засобів як ефективного інструменту контролю за вчиненням злочину. Аналізуються сучасні стратегії боротьби з нелегальним обігом наркотичних засобів, психотропних речовин і прекурсорів із висвітленням нових підходів до визначення та впровадження контрольованої поставки у кримінально-правовій сфері. Сформульовано власне визначення контрольованої поставки наркотичних засобів, психотропних речовин і прекурсорів. The article discusses an innovative approach to understanding the controlled delivery of narcotic drugs as an effective tool for controlling the commission of a crime. The author analyzes modern strategies for combating illicit trafficking in narcotic drugs, psychotropic substances and precursors, highlighting new approaches to the definition and implementation of controlled delivery in the criminal law sphere. The analysis of scientific opinions in the field of defining the essence and concept of «controlled supply of narcotic drugs, psychotropic substances and precursors» has shown that there are different theoretical approaches to such a definition, and each of them deserves attention and is scientifically sound. Given the above, we propose our own definition of the concept under study: controlled supply of narcotic drugs, psychotropic substances and precursors is a set of operational and investigative, criminal procedural, organizational, technical and preventive measures provided for by both international and national legislation, the essence of which is to ensure covert controlled movement (transportation, shipment) both within the state and across its border on the basis of relevant agreements or mutual agreements. Controlled delivery, in terms of its organizational and tactical implementation procedure, has complex stages of preparation and implementation. In view of this, we are convinced that a mechanism of procedural guarantees for the preparation and conduct of controlled deliveries of narcotic drugs or psychotropic substances, precursors within the framework of international cooperation needs to be developed.
