Незаконний обіг зброї в Україні: питання кримінальної відповідальності

Abstract

У статті на підставі результатів вивчення практики застосування ст. 263 КК України та інтерв’ювання працівників Національної поліції України встановлено, що досліджувана норма кримінального закону стала «розмінною монетою» у досягненні правоохоронними органами та судом необхідних показників результативності роботи – фактично діє не охоронна функція кримінального права, а забезпечувальна по відношенню до тих, хто її застосовує. З метою тимчасового вирішення проблеми відсутності встано- вленого законом дозволу на обіг зброї, запропоновано до прийняття закону «Про обіг зброї» суспільні відносини у сфері обігу зброї регулювати шляхом реалізації принципу верховенства права як основного для здійснення правосуддя в Україні.

In the article based on the results of studying the practice of applying of the Art. 263 of the Criminal Code of Ukraine and interviewing of the officers of the National Police of Ukraine the author has found that the researched criminal law norm became «small coin» in achievement by law enforcement agencies and the court of the necessary indicators of effectiveness of their activity - in fact the protective function of criminal law does not work, and the security function does in relation to those who apply it. For temporarily solve the problem of absence of a legal permission for circulation of weapon, the author has proposed to regulate public relations in the sphere of weapon circulation before the adopting of the law «On the circulation of weapon» by realization the rule of law as the main principle for implementation of justice in Ukraine.
