Стан наукових досліджень феномену організації та функціонування органів, які здійснювали карально-репресивні та правоохоронні функції на теренах України у період національно-визвольних змагань (1917-1921 рр.)

Abstract

Висвітлено стан наукового супроводження становлення та розвитку органів, які здійснювали карально-репресивні та правоохоронні функції на теренах України у період національно-визвольної боротьби (1917-1921 рр.). Аргументовано, що наукові праці цього періоду хоча й не були комплексними, однак у найбільш суттєвих рисах розкривали складність та суперечливість процесу становлення таких органів.

The author has highlighted the state of scientific support of formation and development of bodies that carried out punitive-repressive and law-enforcement functions on the territory of Ukraine during the period of national liberation struggle (1917-1921). She has proved that the authors of these works (letters, memoirs, diaries, notes) were mostly state figures, participants in those events. They attempted to analyze the activities of the bodies of self-defense, state guard, prosecutor's office, militia, gendarmerie, police - all those power structures that, in the conditions of the national liberation movement (1917-1921), performed punitive-repressive and law-enforcement functions. The emphasis is placed on the fact that the available studies mostly covered the historical aspects of the formation of these bodies and the individual aspects of their practice. It has been noted that such works can not be considered as complex studies of the issues of organization and functioning of public authorities that carried out punitive-repressive and law-enforcement functions in Ukraine during the period of the national liberation struggle (1917-1921), since they are not fully in place A comprehensive picture of the formation and functioning of these institutions is highlighted; then the system of these bodies; problems of interaction of these security structures and services. These works in the most general terms revealed the complexity and contradictory nature of the process of formation of these bodies during the specified period of attempts to state-building. The main ideas of scientists about the place and role of the bodies that carried out punitive-repressive and law-enforcement functions in the territory of Ukraine during the investigated period were reflected in the normative-legal consolidation of their status. The emphasis has been placed on the relevance of scientists’ works during the period of the national liberation struggle (1917-1921), which are extremely necessary at the present stage of the transformation of law-enforcement agencies of Ukraine (from their punitive and lawenforcement model to the law-enforcement and social-service content of these bodies of public authority).
