Розмежування недбалого зберігання вогнепальної зброї або бойових припасів та суміжних складів злочинів

Abstract

Здійснено розмежування недбалого зберігання вогнепальної зброї або бойових припасів та суміжних складів злочинів, передбачених ст.ст. 119, 128, 196, 263, 267, 367, 414, 425 КК України. Розглянуто розмежувальні ознаки об’єкта, предмета, об’єктивної та суб’єктивної сторони, суб’єкта недбалого зберігання вогнепальної зброї або бойових припасів.

Examine the crime, in addition to the main direct object is public safety in the field of firearms and ammunition, has three additional direct objects: the life of a person, their health and property. Determine which object acts as the main direct, which is optional, allows the differentiation a crime provided for conturies. Art.264 of the Criminal Code, on crimes stipulated in the General regulations that establish liability for reckless causing of death, damage to health or property. Differentiation of careless storage of firearms or of combat supplies from the adjacent warehouses crimes behind a crime may carry out only with regard to other signs part of the offense, in particular, such signs of the objective side as the Act.
