Тактика проведення слідчого експерименту при розслідуванні крадіжок з приміщень магазинів

Abstract

На основі аналізу матеріалів кримінальних проваджень та слідчої практики визначено види слідчого експерименту при розслідуванні крадіжок з приміщень магазинів, досліджено основні проблеми, що виникають під час його проведення на практиці. Запропоновано тактичні прийоми слідчого експерименту залежно від етапів проведення цієї слідчої (розшукової) дії.

In the article marked that an inquisitional experiment is one of important inquisitional actions. Active counteraction to pre-trial investigation, complication of criminal realizations, duration of criminal activity and presence of numerous contradictions and substantial divergences, stipulate the important value of inquisitional experiment. Having regard to it, effective realization of this inquisitional action in a great deal depends on ability inquisitional to apply tactical receptions. The indicated inquisitional action has features at investigation of crimes of separate kind, in particular thefts from the apartments of shops. From the analysis of materials of criminal realizations and it is set questioning of investigators, that during investigation of thefts from the apartments of shops such types of inquisitional experiment are more often conducted: from establishment of mechanism of criminal event or his separate elements; in relation to possibility of feasance of certain actions; from establishment of presence or absence for the concrete face of professional skills; from establishment of observability or perception of certain fact, phenomenon. Certainly, that by the basic tactical receptions of realization of this inquisitional action following: realization of inquisitional experiment in terms, maximally close to that, in that there was an event, fact or phenomenon; the use is during the inquisitional experiment of the same instruments, facilities and objects that was used during doing of crime; the repeated reiteration of homogeneous tests is with the changes of terms of experiments; division of experiments is on the stages and their stage-by-stage realization; optimal limitation of amount of participants of inquisitional experiment; carrying out experimental tests or tests with every suspected separately; maintenance of psychological contact is with the participants of inquisitional experiment; there is watching behavior of persons with participation of that conducted experiment or tests; comparisons of actions, that is recreated by a person during an inquisitional experiment, with the real situation in place and grant to possibility to the witness, victim or suspected to explain divergences, if such are. As a result is marked, that an inquisitional experiment is the most labors intensive and difficult inquisitional action in pre-trial realization, as a far of persons participates in him. Quality and effective realization of this inquisitional action requires careful preparation, clear organization and use of row of tactical receptions and combinations, which will allow getting truthful testimonies and taking involvement of certain persons to criminal activity.
