Поняття і зміст оперативно-розшукового забезпечення розслідування незаконного переміщення вогнепальної зброї

Abstract

Досліджено зміст оперативно-розшукового забезпечення розслідування незаконного переміщення вогнепальної зброї та визначено це поняття. У результаті аналізу думок вчених стосовно значення «оперативно-розшукового забезпечення» і «оперативно-розшукового супроводження» автор дійшов до висновків, що більш повно цей напрям діяльності слід позначати терміном «забезпечення». Змістовними елементами оперативно-розшукового забезпечення розслідування незаконного переміщення вогнепальної зброї є: 1) своєчасне отримання і надання слідчому, прокурору інформації яка має значення під час розслідування; 2) залучення конфідентів у проведенні СРД та НСРД; 3) використання під час здійснення СРД та НСРД оперативно-технічних засобів та ін. Під оперативно-розшуковим забезпеченням розслідування незаконного переміщення вогнепальної зброї слід розуміти комплекс заходів, спрямованих на своєчасне отримання і надання слідчому, прокурору інформації, яка має значення під час розслідування; залучення конфідентів у проведенні СРД та НСРД; ефективне використання під час здійснення СРД та НСРД оперативно-технічних засобів та ін. з метою вирішення завдань кримінального провадження.

The content of the operatively-search support for the investigation into the illegal movement of firearms was explored and this concept was determined. As a result of the analysis of the opinions of scientists regarding the significance of "operational search security" and "operational search support", the author came to the conclusion that more fully this activity should be indicated by the term "security". The substantive elements of the operative and investigative support for the investigation of the illegal movement of firearms are: 1) the timely receipt and provision of information to the investigator, prosecutor, which matters during the investigation; 2) the involvement of confidentials in the conduct of investigatory search actions (ISA) and covert investigatory search actions (CISA); 3) use during the implementation of the R & D and NCD operational equipment, etc. Under the operational search, the investigation into the illegal movement of firearms should be understood as a set of measures aimed at the timely receipt and provision of information to the investigator, prosecutor, which is relevant during the investigation; involvement of confidential persons in the conduct of ISA and CISA; effective use during the implementation of the ISA and the CISA operational and technical facilities, etc. with the aim of solving the problems of criminal proceedings.
