Феномен Загальної декларації прав людини

Abstract

Надано характеристику правової природи Загальної декларації прав людини та висвітлено вплив її положень на зміну поглядів щодо розуміння прав людини, формування сучасної концепції прав і свобод людини та практичну реалізацію принципів цієї концепції на міжнародному та внутрішньодержавному рівнях. Акцентовано увагу на необхідності підготовки нашою державою офіційного перекладу тексту Загальної декларації прав людини та його розміщення на офіційних сайтах органів державної влади і місцевого самоврядування України.

The article is devoted to the characterization of the legal nature of Universal Declaration of Human Rights and the impact of its provisions on changing views on the understanding of human rights, the formation of a modern concept of human rights and freedoms, and the practical implementation of the principles of this concept at the international and national levels. The emphasis is on the inadmissibility of human rights and freedoms violations, and the strict adherence to international obligations arising from the provisions of both the Universal Declaration of Human Rights and other universally recognized international legal instruments in the field of human rights. The General Assembly of the United Nations, by having adopted resolution No. 217 A (III) on December 10, 1948, proclaimed the Universal Declaration of Human Rights as "a task to which all people and all states must strive for." It encouraged the member states and people to promote respect and ensure the effective recognition and observance of the rights and freedoms enshrined in the Declaration. The adoption of the Universal Declaration of Human Rights resulted in the completion of the work on the protection of human rights, elaborated by centuries, and active actions have been initiated towards the formation of a new independent branch of international human rights law in the system of general international law. Its content resulted from a close interaction of law specialists who represented all the regions of the planet. In it, for the first time in the history of mankind, in the form of a catalog, as a list, the basic human rights that need to be protected at the international and national levels were identified. For the entire community the eloquent proof of the relevance of the Universal Declaration of Human Rights provisions is the fact that it was translated into more than 500 languages (in addition to the six official languages of the United Nations – English, Arabic, Spanish, Chinese, Russian and French, its text has been translated into many other languages, including Papeil – a language spoken by about 50 people in El Salvador and Honduras), and recognition of the day of its adoption as the International Human Rights Day. It is emphasized on the necessity for our state to prepare an official translation of the text of the Universal Declaration of Human Rights and its placement on official sites of Ukrainian state authorities and local government
