Заходи попередження перевищення влади або службових повноважень працівником правоохоронного органу

Abstract

Розглянуто можливі заходи попередження злочину, передбаченого ст. 365 КК України. Обґрунтовано, що перевагу слід надавати загальним заходам попередження цього злочину. До них належать заходи щодо поліпшення системи матеріального й морального стимулювання працівників правоохоронних органів, вдосконалення елементів керівної та організаційної роботи, перегляд існуючої системи контролю й оцінки ефективності роботи тощо.

The author has considered possible measures to prevent the crime enshrined in Art. 365 of the Criminal Code of Ukraine. She has substantiated that the general measures to prevent this crime should be given priority. These include measures to improve the system of material and moral stimulation of law enforcement officers, improvement of the elements of management and organizational work, review of the existing system for monitoring and evaluating the work effectiveness, etc. It has been argued that a personal example of the commander's staff of law enforcement bodies is of great importance for the formation of law-abusive behavior in the personnel. It is clear that at the same time, the educators themselves should be properly prepared both in spiritually moral and professional terms to work with the staff, to be an example in the observance of the rule of law and discipline, the perfect fulfillment of the oath, statutes and orders, morality rules, to develop and to support the subordinates of a conscious attitude to the performance of official duties, a sense of honor and dignity, to encourage a strong initiative, independence in the service, strictly punish for negligence. It has been established that the prevention of excessive power or official authority by law enforcement officers can not operate effectively without the implementation of preventive measures for all crime. At the same time, among these measures, priority should be given to general measures of prevention. These include measures to improve the system of material and moral incentives for law enforcement officers, improving the elements of leadership and organizational work, reviewing the existing system of monitoring and evaluating the effectiveness of law enforcement. It is expedient to use preventive measures with the use of opportunities not only of law enforcement agencies, but also of other state institutions and the public.
