dc.description	The study deals with the powers in accordance with the tasks and objectives of the municipal guard, which operates in different cities of Ukraine, local communities and more. Emphasis is placed on the lack of normative regulation (at the level of the Law) of the definition of such a concept as «municipal guard» or «municipal police», which leads to different interpretations and interpretations by members of the scientific community. The opinions of many researchers on such concepts as «municipal police» and «municipal guard» are highlighted, the content of such definitions allows us to draw conclusions about the priority in ensuring or maintaining public order by the municipal guard. These are two main approaches to the content of the activities and organization of the municipal police, namely centralization of law enforcement in the state, when municipal police officers must be in the staff of the Ministry of Internal Affairs of Ukraine and not subordinate to local governments. police funding, and the powers, structure and personnel policy remain with the National Police of Ukraine; the second approach envisages the functioning of the municipal police as an executive body of local self-government, the municipal police is accountable to and under the control of local self-government bodies and the territorial community. It is stated that in accordance with the second approach and analysis of the statutes of municipal enterprises of some cities under the name «Municipal Guard», the terms «municipal police» and «municipal guard» are identical. Emphasis was placed on the need to adopt the Law on Municipal Guard, which established the powers of the guard, including maintaining public order, crime prevention and security activities as priority areas of the guard, the administrative and legal status of the guard, determined sources of funding (local community budget). accountability and control of representatives of the municipal guard.	uk_UA
dc.description.abstract	У дослідженні йдеться про повноваження відповідно до покладених завдань та мети діяльності муніципальної варти, яка діє в різних містах України, територіальних громадах тощо. Акцентовано на відсутності нормативного регулювання (на рівні Закону) визначення такого поняття, як «муніципальна варта» або «муніципальна поліція», шо призводить до різного тлумачення й трактування представниками наукової спільноти). Висвітлюються думки багатьох дослідників на такі поняття, як «муніципальна поліція» та «муніципальна варта». Зміст таких визначень дозволяє зробити висновки про пріоритетність у забезпеченні або підтриманні громадського порядку муніципальною вартою. Наголошено на необхідності прийняття Закону «Про муніципальну варту», норми якого встановлювали б повноваження варти, в тому числі щодо підтримання громадського порядку, профілактики правопорушень та охоронної діяльності як пріоритетних напрямів діяльності варти, адміністративно-правовий статус вартового, визначав би джерела фінансування (місцевий бюджет громади), підзвітність і підконтрольність представників муніципальної варти.	uk_UA
