dc.description	From the point of view of the scientific validity and practice of the functioning of penal and probation institutions, the article reveals the state of research into the problems of the execution of court decisions on convicts in Ukraine. It is noted that among the directions of the transformation of the penal system of Ukraine into the penitentiary system, such a direction as strengthening the protection of the rights and freedoms of convicts through the proper execution of a court decision in accordance with the requirements of international legal acts and the obligations of our state to the European and world community is highlighted. In view of the fact that the problem of studying the implementation of court decisions on convicts in Ukraine has its own specific characteristics, the article proves that their role as a regulator of public relations is constantly growing. The article was prepared as part of the fundamental study «Criminal Enforcement Bases for the Execution of Court Decisions on Convicts in Ukraine,» in three areas of study; 1) scientific, methodological and applied basis of execution of court decisions on convicts in Ukraine; 2) implementation by the subjects of execution of court decisions on convicts in Ukraine; 3) peculiarities of execution of court decisions on convicts in Ukraine. Consequently, the problems of enforcement of court decisions on convicts in Ukraine are among the little-studied in the science of criminal enforcement law of Ukraine. This conclusion is based, in particular, on the fact that during the years of independence of Ukraine not a single candidate was defended, not to mention a doctoral dissertation that would cover the current problems of the execution of court decisions on convicts in Ukraine. This problem is particularly acute at a time when, according to the Concept of Reform (Development) of the Penitentiary System, Ukraine is undergoing a major reform of the penal system and its transformation into a penitentiary system. It has been proved that a characteristic feature of the state of scientific research of the above problem is also scientific works in which researchers violated, studied and solved certain aspects of the implementation of court decisions on convicts in Ukraine and foreign countries. Unfortunately, some rational areas of improvement of the existing legislation or the practice of their application in the subject of research have not found their solution in the Ministry of Justice of Ukraine. Moreover, the scientific papers we have studied do not give sufficient attention at all to the study of the jurisprudence of the European Court of Human Rights regarding inadequate enforcement in probation authorities and penal institutions of the execution of court decisions on convicts, which in turn gives rise to a general view of the problems characterizing the corresponding practice of convicts for the protection of their rights.	uk_UA

Зазначено, що серед напрямів трансформації кримінально-виконавчої системи України в пенітенціарну систему виділено такий її напрямок, як посилення захисту прав і свобод засуджених шляхом належного виконання судового рішення відповідно до вимог міжнародних правових актів і зобов‟язань нашої держави перед європейським та світовим співтовариством.	uk_UA
