Название: Перспективи функціонування територіальних громад у післявоєнний період Авторы: Дзюба, Ірина; Dzyuba, Iryna Краткий осмотр (реферат): Стаття присвячена комплексному аналізу післявоєнного відновлення територіальних громад України, які зіштовхнулися з масштабними інфраструктурними руйнуваннями, демографічними змінами та зростанням соціальних потреб. Розглянуто проблеми недостатньої фінансової, управлінської та кадрової спроможності, що ускладнюють реалізацію програм відбудови. Наголошено на важливості формування довгострокових стратегій розвитку, спрямованих на модернізацію інфраструктури, цифровізацію управління, підтримку місцевого бізнесу та інтеграцію внутрішньо переміщених осіб. Акцентовано на ролі міжнародної підтримки як чинника, що посилює можливості громад у реалізації проєктів. Підкреслено, що ефективне відновлення можливе лише за умови поєднання внутрішнього потенціалу, зовнішніх ресурсів та активної участі населення у процесах ухвалення рішень, що забезпечить стійкий розвиток громад у післявоєнний період. The article examines the key challenges and prospects for the post-war recovery of Ukraine’s territorial communities, which, in the context of decentralization reform, have gained expanded powers and become the main actors in local development. It is emphasized that the war has caused large-scale destruction of critical, social, and economic infrastructure, changes in the demographic structure, and an increased burden on the social services system. In these conditions, the effectiveness of communities largely depends on their institutional capacity, ability to adapt management models, and mobilize internal and external resources. Scientific approaches to the transformation of local self-government are analyzed, in particular the importance of strategic planning, infrastructure modernization, human resource development, and strengthening partnerships with state bodies, business, international organizations, and the public. It is emphasized that reconstruction should be viewed not as a return to the pre-war state, but as an opportunity for structural modernization of the economy, the introduction of innovative management solutions, and the expansion of digital services. Special attention is paid to issues of social reintegration of the population, support for internally displaced persons and veterans, restoration of small and medium-sized businesses, and creation of a favorable investment environment. It has been determined that the key conditions for sustainable development are the combination of the internal management potential of communities with external financial and expert support, the formation of transparent resource management mechanisms, and ensuring public participation. The authors conclude that the post-war period will be a time of deep transformation for local communities, and its success will depend on comprehensive solutions, coordination between all development actors, and the ability of communities to integrate reconstruction processes with a strategic vision for the future.

Название: Щодо питання визначення поняття та сутності адміністративно-правового регулювання діяльності територіальних громад в умовах воєнного стану Авторы: Дзюба, Ірина; Dzyuba, Iryna Краткий осмотр (реферат): У статті досліджено трансформацію адміністративно-правового регулювання діяльності територіальних громад в умовах воєнного стану. Обґрунтовано необхідність оновленого тлумачення поняття й сутності цього регулювання, зумовлену зміною безпекового середовища, посиленням ролі державної політики та запровадженням спеціальних режимів для процесу управління. Визначено особливості функціонування територіальних громад як соціально-правових спільнот, що зберігають свою суб’єктність попри наявні загрози. Проаналізовано нормативно-правові засади місцевого самоврядування й окреслено ключові напрями його трансформацій, які є зумовленими: зростання мобілізаційної ролі громад, підвищення відповідальності за реалізацію державної політики, необхідність адаптації правових механізмів до кризових умов і посилення контролю за використанням наявних ресурсів. Наголошено на потребі наукового переосмислення сутності адміністративноправового регулювання з огляду на здійснення безпекових і стратегічних функцій. The article is devoted to a comprehensive theoretical and legal analysis of the concept and essence of administrative and legal regulation of the activities of territorial communities under martial law. It is emphasized that the current challenges caused by the full-scale invasion of the Russian Federation have led to a significant rethinking of the role and functioning of territorial communities, as a significant part of them found themselves in the combat zone, suffered occupation or significant demographic and economic changes. In such conditions, traditional approaches to administrative and legal regulation have proved insufficient, as the activities of communities go beyond the usual provision of public services and concern the maintenance of the state’s defense capability and stability. The article examines doctrinal approaches to defining a territorial community as the primary subject of local self-government, emphasising its socio-legal nature and the importance of preserving community identity even in conditions of mass evacuation of the population. The author analyzed the provisions of normative acts that define the legal status of communities, their principles of operation, and their interaction with state authorities. Particular attention is paid to the importance of the principles of accountability, autonomy, and judicial protection of local self-government rights. It has been established that under martial law, administrative and legal regulation has undergone significant transformations in the direction of strengthening the role of state policy, introducing special management regimes, community participation in mobilization processes, ensuring territorial defense, and social protection of the population. The impact of centralization mechanisms, in particular the activities of military administrations, on the independence of territorial communities has been analyzed. In conclusion, it is emphasized that effective administrative and legal regulation under martial law is a key factor in ensuring stability, security, and further development of territorial communities.
