Розглянуто розмежувальні ознаки об’єкта, предмета, об’єктивної та суб’єктивної сторони, суб’єкта недбалого зберігання вогнепальної зброї або бойових припасів.; There is the limitation between careless storage of firearms or combat supplies and adjacent syllables of the crimes envisaged by art. 119 of the Criminal Code «Murder through carelessness», art. 128 of the Criminal Code«Careless grave or average gravity bodily injury», art. 196 of the Criminal Code«Careless destruction of or damage to property», art. 263 of the Criminal Code «Illegal conduct with weapons, combat supplies or explosives», art. 267 of the Criminal Cod «Violation of rules of the explosive, flammable or caustic substances or radioactive materials», art. 367 of the Criminal Code «Negligence», art. 414 of the Criminal Code«Violation of the rules dealing with weapons, as well as substances and objects that make up an increased danger to the environment» and art. 425 of the Criminal Code«Careless attitude to the military service». Examine the crime, in addition to the main direct object is public safety in the field of firearms and ammunition, has three additional direct objects: the life of a person, their health and property. Determine which object acts as the main direct, which is optional, allows the differentiation a crime provided for conturies. Art.264 of the Criminal Code, on crimes stipulated in the General regulations that establish liability for reckless causing of death, damage to health or property. Differentiation of careless storage of firearms or of combat supplies from the adjacent warehouses crimes behind a crime may carry out only with regard to other signs part of the offense, in particular, such signs of the objective side as the Act. Acts as a sign of an objective side in this crime is the negligent storage of firearms or combat supplies. Careless storage of firearms or of combat supplies from related crimes also we featured subjective side. Mental attitude person to any of the socially dangerous consequences of this crime is characterized by only careless form fault in the form of criminal arrogance or criminal negligence. Surveyor of art. 264 of the Criminal Code does not contain links to additional special signs of the subject of this Act. On the basis of this it can be argued that the subject of this crime is common. That is asane person who negligently maintained firearms or combat equipment, which resulted in loss of life or other grave consequences, the age from which can arise criminal liability.

Сформульовано на цій основірекомендації щодо особливостей кваліфікації злочину, передбаченого ст. 264 КК України. Зокрема, розглянуті ознаки суспільно небезпечного діяння як ознаки цього злочину та запропоновано внесення змін до КК України у частині розширення переліку можливих форм цього діяння.; Рассмотрены отдельные аспекты предмета доказывания в уголовных производствах о небрежном хранении огнестрельного оружия или боевых припасов. Сформулированы рекомендации относительно особенностей квалификации преступления, предусмотренного ст. 264 УК Украины. В частности, рассмотрены признаки общественно опасного деяния как признака этого преступления и предложено внесение изменений в УК Украины в части расширения перечня возможных форм этого деяния.; In art. 264 of the Criminal Code establishes liability for negligent storage of firearms or ammunition, if this was the cause of death or other serious consequences. The norm is blanket disposition, i.e. to determine signs of actions (inaction), it is necessary to address the secondary regulations, which establish rules for the storage of firearms or ammunition. Main Act is the instruction on the procedure of manufacture, acquisition, storage, accounting, transportation and use of firearms, pneumatic and cold weapons, devices, domestic production for ejection of cartridges filled with rubber or similar properties non-lethal projectiles, and mentioned cartridges and ammunition, weapons and explosives, approved by order of the Ministry of Internal Affairs of Ukraine No. 622 21.08.1998. In the title of this regulation provides guidance on different forms of possible firearms and ammunition (not just storing them). Under the possession of firearms or ammunition in understanding art. 264 of the Criminal Code, in our view, should understand ownership (regardless of duration in time) legally or without authorization (with delay of its actions) in any of the items, which is not in your face, and a privileged location. Apply a broad interpretation to art. 264 of the Criminal Code and the recognition of the transfer of weapons to others, its wearing, carriage storage is contrary to this principle of penal law as banning the use of the criminal law by analogy, pinned h. 4 art. 3 of the Criminal Code. Specifying the disposition art. 264 of the Criminal Code all possible forms of neglect with firearms or ammunition will assist in preventing errors in the practical application of this rule would be consistent with the existing legislation of Ukraine, which regulates and protects the scope of circulation of arms and ammunition. Offer disposition art. 264 of the Criminal Code, after the words "storage" add the words "bearing, transferring, transporting or forwarding.
