Обґрунтовано необхідність оновленого тлумачення поняття й сутності цього регулювання, зумовлену зміною безпекового середовища, посиленням ролі державної політики та запровадженням спеціальних режимів для процесу управління. Визначено особливості функціонування територіальних громад як соціально-правових спільнот, що зберігають свою суб’єктність попри наявні загрози. Проаналізовано нормативно-правові засади місцевого самоврядування й окреслено ключові напрями його трансформацій, які є зумовленими: зростання мобілізаційної ролі громад, підвищення відповідальності за реалізацію державної політики, необхідність адаптації правових механізмів до кризових умов і посилення контролю за використанням наявних ресурсів. Наголошено на потребі наукового переосмислення сутності адміністративноправового регулювання з огляду на здійснення безпекових і стратегічних функцій. The article is devoted to a comprehensive theoretical and legal analysis of the concept and essence of administrative and legal regulation of the activities of territorial communities under martial law. It is emphasized that the current challenges caused by the full-scale invasion of the Russian Federation have led to a significant rethinking of the role and functioning of territorial communities, as a significant part of them found themselves in the combat zone, suffered occupation or significant demographic and economic changes. In such conditions, traditional approaches to administrative and legal regulation have proved insufficient, as the activities of communities go beyond the usual provision of public services and concern the maintenance of the state’s defense capability and stability. The article examines doctrinal approaches to defining a territorial community as the primary subject of local self-government, emphasising its socio-legal nature and the importance of preserving community identity even in conditions of mass evacuation of the population. The author analyzed the provisions of normative acts that define the legal status of communities, their principles of operation, and their interaction with state authorities. Particular attention is paid to the importance of the principles of accountability, autonomy, and judicial protection of local self-government rights. It has been established that under martial law, administrative and legal regulation has undergone significant transformations in the direction of strengthening the role of state policy, introducing special management regimes, community participation in mobilization processes, ensuring territorial defense, and social protection of the population. The impact of centralization mechanisms, in particular the activities of military administrations, on the independence of territorial communities has been analyzed.
