Краткий осмотр (реферат): У дисертації на монографічному рівні досліджено теоретичні та практичні аспекти розслідування хуліганства, вчиненого із застосуванням вогнепальної або холодної зброї чи іншого предмета, спеціально пристосованого або заздалегідь заготовленого для нанесення тілесних ушкоджень. На основі глибокого й системного аналізу представлено криміналістичну характеристику хуліганства, сформульовано її поняття та визначено основні структурні елементи. Дисертантом розглянуто способи й знаряддя учинення хуліганства, з’ясовано зміст обстановки та слідову картину злочину, надано характеристику особи злочинця та потерпілого. Визначено алгоритми дій слідчих і працівників оперативних підрозділів відповідно до типових слідчих ситуацій та окреслено особливості їхньої взаємодії. Здійснено системний аналіз організаційно-тактичних основ забезпечення розслідування хуліганства. Розроблено тактичні рекомендації з тактики проведення огляду, обшуку, допиту підозрюваного, потерпілого та свідка. Досліджено особливості використання спеціальних знань. Виокремлено тактичні помилки й прорахунки, що їх припускаються слідчі під час проведення окремих слідчих (розшукових) дій. Сформульовано ряд конкретних пропозицій і рекомендацій, спрямованих на удосконалення теоретико-правових засад кримінально-процесуальних відносин, уточнено деякі категорії кримінального процесу та криміналістики. The thesis is for candidate’s degree of law on specialty 12.00.09 – Criminal Procedure and Criminalistics; Forensic Examination; Operational-Search Activity. – The Dnipropetrovs’k State University of Internal Affairs of the Ministry of Internal Affairs of Ukraine, Dnipro, 2016. In dissertation at monographic level the theoretical and practical aspects of investigation of the hooliganism, accomplished with the use of fire or cold weapon, and also another objects specially adjusted for causing of bodily harms, are considered. On the basis of deep and system analysis criminalistics description of the investigated type of hooliganism is presented. The structure of this scientific category is thus certain through the analysis of this crime. Lecture description of her structural elements is presented: method and instruments of commission of crime, his situation, track picture, personality of victim and criminal. The sources of primary information the presence of that stipulates the necessity of prosecuting a pretrial inquiry are classified. The typical inquisitional situations of investigation are set forth. The basic algorithms of actions of employees of police, consisting of inquisitional (search) and another action mark according to them. The role of investigator is certain during realization of cooperating with operative subdivisions of police, and also her separate forms most widespread during investigation of the investigated kind are considered The tactical techniques of incident site inspection, interrogation of witnesses, victims, and suspected, crime re-enactment and submission for identification are defined. The significance of this article is evident from the necessity of the comparative analysis of a positive and effective experience of the acting systems of informatization of the criminal justice system of different countries in order to resolve the issue of reforming the criminal justice system of Ukraine by means of creating an information system of pre-trial investigation – electronic criminal justice system in Ukraine with the purpose of improving the modern concept of the electronic component of the criminal justice system in order to realize the fundamental principles of a democratic society such as access to justice as one of the key principles of ensuring legislative rights and freedoms of a person in a democratic state. This research paper contains the analysis of the experience of the innovative technology functions in the electronic systems of the official bodies of the criminal justice system in the context of reviewing the application of various information programs based on the model and methods of receiving and saving information; performance analysis of the program’s strategic elements; comparison of the complex approach methods to implementing innovative processes of organization, application and control in the electronic criminal proceedings in different countries.
