Визначено, що адміністративно-правовий захист публічних коштів – це система заходів, спрямованих на збереження та ефективне використання публічних фінансів, запобігання їх нецільовому використанню, розкраданню та корупції. З’ясовано, що систему адміністративно-правового захисту публічних коштів складають: нормативно-правові акти, які регулюють відносини адміністративно-правового захисту публічних коштів; система органів публічної влади, які забезпечують адміністративно-правовий захист публічних коштів; форми, методи, засоби та способи адміністративно-правового захисту публічних коштів. Доведено, що засобами та способами адміністративно-правового захисту публічних коштів є: фінансовий аудит, перевірки використання публічних коштів, контроль за тендерними процедурами, перевірка декларацій посадовців, які дотичні до акумулювання, використання та розподілення публічних коштів (посадових осіб з високим рівнем корупційного ризику), застосування фінансових санкцій, застосування дисциплінарної відповідальності до посадових осіб, застосування заходів адміністративної відповідальності за порушення у сфері публічних фінансів. The article clarifies the concept and characteristics of public funds as an administrative-legal category and defines the systems of their administrative-legal protection. As a result of the study, it was established that public funds are funds of the state budget, the budget of the Autonomous Republic of Crimea and local budgets, public funds of European and world institutions involved in use in Ukraine, foreign credit resources provided under state and local guarantees, funds of the National Bank of Ukraine, state banks, state trust funds, the Pension Fund of Ukraine, funds of mandatory state social insurance, as well as funds of state and municipally owned business entities received by them from their economic activities. It has been determined that the administrative and legal protection of public funds is a system of measures aimed at preserving and effectively using public finances, preventing their misuse, embezzlement, and corruption. It was found that the system of administrative-legal protection of public funds consists of: regulatory legal acts that regulate relations of administrative-legal protection of public funds; a system of public authorities that provide administrative-legal protection of public funds; forms, methods, means and ways of administrative-legal protection of public funds. It has been proven that the means and methods of administrative and legal protection of public funds are: financial audit, verification of the use of public funds, control over tender procedures, verification of declarations of officials related to the accumulation, use and distribution of public funds (officials with a high level of corruption risk), application of financial sanctions, application of disciplinary liability to officials, application of administrative liability measures for violations in the field of public finances. It has been established that in order to consolidate the concept, characteristics and list of public funds in national legislation, it is advisable to either adopt a comprehensive Law of Ukraine “On Public Property”, which should define the concept of public property (property) and public funds, their characteristics and types, or to define clear characteristics and types of public funds according to the criterion of their division into national, local and extra-budgetary funds in the Budget Code of Ukraine and the Law “On Local SelfGovernment”.
