осліджено криміналістично значущі особливості способів вчинення злісного невиконання
обов’язків по догляду за дитиною або за особою, щодо якої встановлена опіка чи піклування.
Увагу надано описанню способів вчинення злочину, з’ясуванню їх особливостей, визначенню
факторів, які впливають на їх формування, на підставі чого здійснено їх аналіз, систематизацію та
класифікацію. У статті розкрито основні способи, за допомогою яких вчиняються злочини –
невиконання обов’язків по догляду за дитиною або за особою, щодо якої встановлена опіка чи
піклування.
Суть розробки, основні результати:
The article is devoted to the investigation of
forensically significant features of the ways of committing malicious non-fulfillment of duties to care for
a child or a person for whom guardianship or care has been established. Attention is paid to describing the
methods of committing a crime, clarifying their features, determining the factors that influence their
formation, on the basis of which their analysis, systematization and classification were carried out. The
article discloses the main methods by which crimes are committed – failure to fulfill obligations to care
for a child or a person for whom care or guardianship has been established.
The results of the generalization of judicial and investigative practice, the survey of respondents,
as well as the analysis of scientific literature showed that in practice the following methods are most often
used to hide the malicious failure to fulfill the duties of caring for a child or a person for whom
guardianship or guardianship has been established: 1) providing false information to bodies and officials;
2) accusing the victim of defamation; 3) changing the situation at the scene; 4) influence on the victim or
witnesses by the person committing the crime, with the aim of forcing them to give false testimony;
5) forgery of documents or use of a knowingly forged document.
A feature of the illegal act of the guilty person during the commission of the crime provided for in
Article 166 of the Criminal Code of Ukraine is that it can be committed in different ways. At the same
time, it should be emphasized that the manifestation of one criminal act can be combined in two or even
more ways. For example, inadequate provision of medical care to the victim may be inextricably linked to
such a method as inadequate provision of food, etc.
