Досліджено право на свободу та особисту недоторканність крізь призму нормативно-
правових актів в Україні та Італії. Висвітлено нормативно-правову базу Італії, в якій закріплено
положення щодо забезпечення і дотримання права на свободу та особисту недоторканність.
Звернено увагу на сприйняття італійським законодавством стандартів у цій сфері та вжиття
відповідних заходів як Високої Договірної Сторони у Конвенції про захист прав людини і
основоположних свобод.

The right to freedom and personal integrity has been studied
through the prism of normative legal acts in Ukraine and Italy. The normative and legal framework of
Italy, in which provisions regarding the provision and observance of the right to freedom and personal
inviolability, have been established. The attention has been drawn to the adoption of standards in this area
by Italian legislation and the adoption of appropriate measures as a High Contracting Party to the
Convention on the Protection of Human Rights and Fundamental Freedoms.
The author has concluded that ensuring the right to freedom and personal integrity in Italian
legislation is one of the priority directions of the state as a legal entity. Given that Italy is a High
Contracting Party to the Convention for the Protection of Human Rights and Fundamental Freedoms, the
risks of arbitrary violation of the law we are investigating are assessed and measures are taken to reduce
such cases. Italian legislation also pays attention to the assessment of the voluntariness of deprivation of
liberty. Even if a person has voluntarily agreed to the restriction or deprivation of liberty, he cannot be
deprived of the right to liberty and personal integrity. Expressing consent to imprisonment cannot indicate
the automatic provision of the right to freedom and personal integrity, as well as the legality of the
limitation of this right, which is covered by judicial practice and national regulatory legal acts.
