Короткий опис(реферат):
У статті виконано кримінально-правовий аналіз положень чинного кримінального
законодавства України та встановлення його взаємозв’язку із нормами міжнародного права в
частині характеристики сексуального насильства, а також здійснення аналітичного дослідження
судової практики та статистики Офісу Генерального прокурора з метою вироблення на основі
цього висновків.
Наслідками сексуального насильства, визначеними міжнародним правом, треба вважати
фізичні, психологічні, соціальні, соціально-економічні та правові. Для кожної категорії потерпілих
осіб, як-то жінки, чоловіки, діти, крім загальних наслідків, характерними є особливі наслідки –
притаманні саме цим категоріям осіб.
Суть розробки, основні результати:
The article provides a criminal-legal analysis of the provisions of the current
criminal legislation of Ukraine and the establishment of its relationship with the norms of international
law in terms of the characteristics of sexual violence, as well as an analytical study of judicial practice
and statistics of the Office of the General Prosecutor, with the aim of drawing conclusions based on this.
The Criminal Code of Ukraine, in Art. 153, establishes responsibility for committing any violent
acts of a sexual nature, not related to penetration into the body of another person, without the victim’s
voluntary consent, that is, for sexual violence. The objective side of sexual violence is characterized by
actions of a sexual nature that are not related to penetration into the body of another person. The main
immediate object is sexual freedom and sexual integrity of the person. The subjective side of sexual violence
is characterized by direct intent, and the subject of the researched act is a reprehensible male or female
person who has reached the age of 14. The provisions outlined in the scientific work are aimed at improving
criminal law regarding the correct interpretation of the content of Article 153 of the Criminal Code of
Ukraine, taking into account the peculiarities of the national criminal law doctrine.
The analysis of legislative changes in the area of responsibility for sexual violence showed that
the Law of Ukraine «On Amendments to Certain Laws of Ukraine in Connection with the Ratification of
the Council of Europe Convention on the Prevention of Violence against Women and Domestic Violence
and the Fight against them» played a significant role in this phenomena» dated December 6, 2017
No 2227-VIII and the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine
Regarding the Implementation of the Unified Register of Persons Convicted of Crimes against the Sexual
Freedom and Sexual Inviolability of Minors and Strengthening Liability for Crimes Committed against
Sexual freedom and sexual integrity of a minor» dated December 19, 2019 No. 409-IX.
The consequences of sexual violence defined by international law should be considered
physical, psychological, social, socio-economic and legal. For each category of victims, such as women,
men, children, in addition to general consequences, special consequences are characteristic – specific to
these categories of persons.
