Короткий опис(реферат):
Досліджено один із елементів соціальних гарантій військовослужбовця, а саме отримання
грошової компенсації за піднайом житла. Встановлено, що отримання грошової компенсації за
піднайом житла є конституційною гарантією соціального захисту в частині забезпечення житлом
військовослужбовців. Доведено, що гарантії соціального забезпечення військовослужбовців з
урахуванням категорій військовослужбовців та місця проходження ними військової служби в частині
забезпечення житлом є різними. Встановлено, що ризики та наслідки, які виникають у зв’язку з
відсутністю належної соціальної гарантії, негативно впливають на забезпечення національної
безпеки щодо вмотивованості проходження військової служби військовослужбовця. Запропоновано
унормувати грошову компенсацію за піднайом житла з визначенням/встановленням її розміру з
урахуванням різних чинників. The scientific article explores one of the elements
of social guarantees for military servicemen, such as receiving monetary compensation for subletting of
housing. It has been established that receiving monetary compensation for subletting of housing is a
constitutional guarantee of social protection in terms of providing housing for military personnel.
By carrying out an analysis of the normative regulation of provision of housing for military
personnel, it was established that military personnel have the right to housing provision in the form of:
1) residential premises, 2) free accommodation in specially adapted barracks/family dormitories; 3) rental
of residential premises with compensation for subletting (leasing). It has been proven that the provision of
housing in the form of rental of residential premises with compensation for subletting (leasing) has
different approaches/guarantees. The type of category of servicemen, the place of their military service, as
well as the conditions of martial law (use of martial law conditions) affect such approaches/guarantees.
It has been found that the risks and consequences arising from the lack of adequate social
security have a negative impact on the provision of national security in terms of the motivation of military
servicemen. Unified approaches to social guarantees of military personnel in terms of providing housing
in the form of rental of residential premises with compensation for subletting (leasing) through the
unification of monetary compensation for subletting of housing have been proposed. It has been proven
that the following should be taken into account when determining/setting the calculation of the
compensation: the average market price for subletting of housing in Ukraine; the amount of monetary
compensation for subletting (leasing) of housing; the amount of financial support for military personnel.
