На основі аналізу чинного законодавства, наявних наукових, публіцистичних та методичних джерел з’ясовано особливості судового розгляду справ про адміністративні правопорушення, що посягають на встановлений порядок управління, на етапі прийняття рішення по справі. Визначено недоліки Кодексу України про адміністративні правопорушення, що мають місце на етапі прийняття рішення по справі, та запропоновано шляхи їх подолання.
In the article on the basis of analysis of the current legislation, available scientific, journalistic and methodical sources, the peculiarities of the judicial review of cases on administrative violations that violate the established procedure of management, at the stage of decision-making in the case are determined. The shortcomings of judicial practice and administrative-tort law in this area of public relations were revealed and analyzed. It is indicated that the decision on the case is the final and, at the same time, the main stage of judicial review of cases of administrative violations that infringe on the established procedure of administration, during which the application of law is exercised in the proper sense of the word.
A significant shortage of the Code of Ukraine on administrative violations at this stage, which is absent in the procedural law of other branches of law, is related to the absence of a norm that would establish the validity of the decision taken in the case of an administrative offense. That is, the Code of Ukraine on Administrative Offenses does not set out the features that should be inherent in each final judicial act. In addition, rulings on cases of administrative offenses can only be of two types: those who found guilty and accordingly decide on the imposition of a penalty (an order to bring administrative liability) and rulings terminating the proceedings in connection with the existence of grounds for this (the decision to terminate the proceedings). Specific suggestions for improving the institute of administrative responsibility are given.
