dc.description	The article points out the negative impact of the current regulations on the effectiveness of the investigation of crimes. The existing procedural means of combating crime do not correspond to the real needs of ensuring the safety of society from criminal manifestations. For clarity, law enforcement activity was compared with other spheres of society's life and attention was drawn to positive foreign experience. After today, in different areas when copying foreign experience we see not only disregard social features Ukrainian, but also the national legal system. This approach can be traced to reform legal education to the practical implementation of law enforcement. Even the most stable and efficient law enforcement sector - Operational Activities, set in an environment in which its implementation is ineffective. Again, there is no need for point and system reform. And considering that OSA is only one step in combating crime need to change the overall system. It appears the need to change the approach to OSA. In particular, one of the principles OSA is legitimacy. However, his interpretation of both regulations and in most activities are one-sided. Control and supervision of investigative comes to checking the validity of the decisions on the implementation of specific measures regarding the suspect or the accused. This approach confirms Indictment focus of criminal proceedings generally, critically repeatedly pointed scientists. In support of this thesis points out the fact that all without exception procedure for checking the legality of the investigative facts relating to the use of search operations against persons who prepare or commits an offense. As a result, increasing public dissatisfaction with law enforcement and criminals avoid criminal punishment.	uk_UA
dc.description.abstract	У статті вказано на негативний вплив сучасної регламентації ОРД на ефективність розслідування злочинів. Наявні процесуальні засоби протидії злочинності не відповідають реальним потребам гарантування безпеки суспільства від злочинних проявів. Для наочності здійснено порівняння правоохоронної діяльності з іншими сферами життя суспільства та звернуто увагу на позитивний закордонний досвід. Зауважено, що застосування новітніх технологій і методів протидії злочинності у діючій правоохоронній системі не дасть очікуваного результату через застарілість підходів та умов, за яких здійснюється як досудове, так і судове провадження вже виявлених злочинів. Водночас використання закордонного досвіду має бути зваженим й таким, що враховує національні, ментальні та історичні особливості українського суспільства.	uk_UA
