dc.description	The paper has examined the bioethical principles of international private law in the core international acts. Their structure, sequence and connection with the national legislation have been analysed. In particular, the attention has been drawn to the consistency of these principles in international instruments: the Nuremberg Code, the WMA Declaration of Helsinki on the Ethical Principles for Medical Research involving Human Subjects, the Universal Declaration on Bioethics and Human Rights, the Convention on Human Rights and Biomedicine. The latter has been signed, but not yet ratified by Ukraine. The article has defined the norms that determine particular principles of human rights in surrogacy and gender reassignment. It has been emphasised that the bioethical principles adopted by national legal systems are divided into two broad categories that correspond to two theoretical concepts. The first one states that the human body is a person, or rather, the mind and body are one. Subsequently, people cannot have any subjective rights to parts of their body. However, some national legal systems recognise body property rights. This article analyzes the transnational phenomena what is known as reproductive, medical, transplantation or even deadly tourism, it is а burning issues of the times. The legal regulation of surrogacy also is being considered in the papers, in particular, the author underlines three regulatory regimes: an altruistic, allowing and forbidding. Special attention is paid to Oviedo Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine. The International treaty is a manifestation of the effort on the part of the Council of Europe to keep pace with developments in the field of biomedicine; it is notably the first multilateral binding instrument entirely devoted to biolaw.	uk_UA
dc.description.abstract	Досліджено біоетичні засади міжнародного приватного права в основоположних міжнародних нормативно-правових актах. Проаналізовано їх структуру та послідовність і зв’язок із національним законодавством. Проаналізовано транснаціональні явища, що мають назву: репродуктивного, медичного, трансплантаційного або навіть смертельного туризму, вони доволі поширені та є нагальною проблемою сьогодення. Досліджено правове регулювання сурогатного материнства, серед якого існують три основні режими його здійснення: альтруїстичний, дозвільний та заборонний. Акцентовано увагу на тому, що біоетичні засади, прийняті національними правовими системами, поділяються на дві широкі категорії, що відповідають двом теоретичним концепціям. Відповідно до одних національних правових систем, людське тіло − це особистість, а точніше – розум і тіло єдині. Тобто люди не можуть мати жодних суб’єктивних прав на частини свого тіла. А інші національні правові системи дозволяють право власності на тіло.	uk_UA
