Організаційно-підготовчі заходи до проведення обшуку при розслідуванні проти моральності

Abstract

Досліджено деякі аспекти розслідування злочинів проти моральності. Розглянуто організаційно-підготовчі особливості обшуку при розслідуванні досліджуваної категорії кримінальних правопорушень, а також сформульовано пропозиції щодо застосування найбільш доцільних його заходів.

The scientific article deals with of some aspects of the investigation of the crimes against morality. We consider the organizational features of investigation of search in the investigation of the studied category of criminal offenses are examined too. An important value for effective investigation of crimes against morality plays a search. In fact he allows educing material tracks of criminally-punishable act. Careful preparation to this inquisitional (of criminal investigation) action, correct and expedient use of corresponding tactical receptions during her realization, allows far to increase an evidential base and disrobe guilty. Methods of committing crime against morality, from data of our research, at 82 % cases are full structural; consist of preparation, direct of act and concealment. The last constituent is concealment, possibility of elimination or shelter of crime, things obtained by a criminal way instruments determines, objects from on tracks a crime and others like that. Taking into account it, realization of search at presence of for those grounds is not only a right but also duty of investigator.
