Abstract: У статті розглянуто позитивне стимулювання як одна з основних форм охорони правопорядку та протидії злочинності. Підкреслено важливість стимулювання у всіх сферах суспільної діяльності та недостатнє застосування у сфері охорони правопорядку. Доведено необхідність поширеного застосування позитивного стимулювання в правоохоронній сфері для забезпечення розвитку громадянського суспільства.
Description: State - the highest form of social organization that provides protection and coordination of individual, group and general public interests through the law in a particular area. So the government, in other words - is orderly phenomenon, the existence of which depends on consistency in regulating the relationship between the backbone elements. Ignoring mandatory rules, even large, eventually leading to destruction of the system. Whether we like it the work of civil society can exist and develop only if coherence backbone elements in a state that is provided by the relevant institutions. Deficiencies in their work can not ensure the proper functioning of the state machinery, and therefore do not contribute to the development of civil society. The purpose of the article show the destructiveness of public policy in law enforcement and the need to bring the spread of positive incentive in it for the development of civil society in Ukraine. If we consider the population as a collective enterprise called "state", then the regulation of relations it must comply with mandatory rules for team. And given that crime, though negative, but inherent in the phenomenon of society, those rules should apply on him. Consequently, the management of any team, as a society by various methods, one of which is a method of stimulation, which includes incentives and castigation. Only a balanced application of the latter ranging from the training can have a positive effect, otherwise the situation gets out of control. In the case of combating crime we are in 99% of cases only see the castigation, while encouragement hardly used, with rare exceptions exemption from criminal liability. Even work with confidential employees operating units is based, to a greater extent for fear of compromising materials than obtaining some benefit. At the same time, long practiced in the west incentives participation of citizens in exposing criminal activity, there are cases receive remuneration in the hundreds of thousands of dollars. We believe that good citizens stimulation to actively conduct on law enforcement activity fold increase in its effectiveness. While the punishment of offenders will not have such an effect, even if identified and imposing penalties on all violators without exception, because their number compared to the good citizens always much less. One can only hope that this understanding will not only scientists, but in society as a whole, resulting in the corresponding fixing legislation.
