Нормативно-правове регулювання сфери освіти в умовах воєнного стану

Abstract

Досліджено особливості нормативно-правового регулювання сфери освіти в умовах воєнного стану. На основі аналізу законодавчих та підзаконних нормативно-правових актів було визначено гарантії для учасників освітнього процесу в умовах війни, повноваження Міністерства освіти і науки України стосовно питань правового забезпечення функціонування сфери освіти. Також проаналізовано нормативні аспекти організації освітнього процесу у закладах освіти в умовах воєнного стану, зокрема щодо форми продовження освітнього процесу, його завершення та проведення вступної кампанії. З’ясовано, що правове регулювання у сфері освіти насамперед спрямоване на забезпечення безпеки всіх учасників освітнього процесу та необхідності продовження реалізації права на освіту. The article examines the peculiarities of normative-legal regulation of the sphere of education under the conditions of martial law. On the basis of the analysis of legislative and sub-legislative legal acts, guarantees were established for the participants of the educational process in wartime conditions, the powers of the Ministry of Education and Science of Ukraine regarding issues of legal support for the functioning of the education sphere. Normative aspects of the organization of the educational process in educational institutions under martial law are also analyzed, in particular, regarding the form of going on of the educational process, its completion, and the conduct of the admissions campaign. It was found that legal regulation in the field of education is primarily aimed at ensuring the safety of all participants in the educational process and the need to continue the implementation of the right to education for everyone. It remains relevant to continue the study of this topic, because regulatory and legal regulation in the conditions of martial law is a dynamic process. The issue of researching the legal aspects of the organization of the educational process in the new academic year, the regulation of obtaining education by persons who were forced to leave the territory of Ukraine, the legal features of ensuring the quality of education, etc., becomes relevant.
