Взаємодія ДМС України з іншими суб’єктами щодо протидії адміністративним правопорушенням, учинюваним іноземцями в умовах воєнного стану

Abstract

У статті досліджено взаємодію Державно-міграційної служби України (далі – ДМСУ) із іншими суб’єктами щодо протидії адміністративним правопорушенням вчинюваними іноземцями в умовах воєнного стану. Визначено, що взаємодія як діяльність має бути узгоджена за метою, місцем, часом, методами. Наголошено, що здебільшого поряд із єдиною метою є певні цілі взаємодії суб’єктів владних повноважень, що умовно можна поділити на два види: першорядні та другорядні. У контексті зазначеного науковий та практичний інтерес становить аналіз реалізації поставлених цілей щодо протидії адміністративним правопорушенням іноземцями ДМСУ, у взаємодії з представниками громадськості щодо оперативного інформування про відомі факти та осіб, які є порушниками міграційного законодавства в інформаційно-комунікаційній площині. Обґрунтовано необхідність запровадження та створення нових підходів ДМСУ щодо організації взаємодії з населенням у інформаційно-комунікативній складовій для запобіганні та протидії адміністративним правопорушенням, учинюваним іноземцями, зокрема в умовах воєнного стану. The article examines the interaction of the State Migration Service of Ukraine with other entities in combating administrative offenses committed by foreigners under martial law. It was determined that interaction as an activity should be coordinated in terms of purpose, place, time, and methods. Attention is drawn to the fact that in most cases, along with a single goal, there are certain goals of the interaction of subjects of power, which can be conditionally divided into two types: primary and secondary. In the context of the above, it is of scientific and practical interest to analyze the implementation of the goals set for countering administrative offenses by foreigners of the State Migration Service of Ukraine, in cooperation with representatives of the population (public) regarding operational information on known facts and persons who are violators of migration legislation in the information and communication sphere. The necessity of introducing and creating new approaches of the State Migration Service of Ukraine regarding the organization of interaction with the population (public) in the informational and communicative component in preventing and countering administrative offenses committed by foreigners, in particular in the conditions of martial law, is substantiated. Summing up, the author states that the interaction of the State Migration Service of Ukraine with other subjects regarding countering administrative offenses committed by foreigners under martial law should be carried out taking into account modern information and telecommunication capabilities. One of these tools is a specialized chatbot available to ordinary citizens, which is able to attract the widest possible circle of people to cooperate with the and State Migration Service of Ukraine positively influence the receipt of information about illegal migrants in the conditions of martial law. At the same time, in addition to its main informative function, this product is capable of acting as an educational tool for raising the legal awareness of citizens and forming patriotic qualities that are absolutely necessary in the period of martial law.
