Правові стандарти у сфері захисту прав дітей в умовах збройного конфлікту в Україні

Abstract

В умовах війни особливої уваги потребують діти, які є найбільш вразливою групою і стають головними жертвами воєнних дій. Діти, які опиняються в епіцентрі збройних конфліктів, стикаються з безпосередньою загрозою для свого життя та здоров'я, психологічним травмами та обмеженням доступу до освіти та засобів проживання. Особливо гостро ці проблеми відчуваються в Україні, яка зазнала агресії з боку російської федерації на своїй території. Кількість дітей, постраждалих внаслідок збройної агресії, залишається високою, що ставить перед українським урядом серйозні завдання забезпечення їхньої безпеки, освіти та соціальної адаптації. Досягнення позитивних результатів в цій сфері потребує впровадження комплексних заходів з покращення доступу до якісної медичної допомоги, освіти та соціальної підтримки для дітей, постраждалих від конфлікту. Це передбачає створення спеціальних центрів реабілітації, психологічної підтримки та соціальної адаптації для забезпечення повноцінного розвитку для кожної дитини, постраждалої від воєнного конфлікту. Ensuring the peaceful coexistence of people and preserving peace and well-being is the main task of any country. Countries around the world spend a lot of energy and resources on creating and operating international organizations whose purpose is to prevent armed conflicts, the consequences of which are massive violations of human rights, especially the rights of children. The activities of many international organizations are specifically aimed at ensuring the security of their member states. This again emphasizes the importance of ensuring the right to safety of persons, especially children, who belong to a particularly vulnerable group in need of protection. Children's rights are violated during armed conflicts. The article examines the effects of armed aggression on the lives of children. It reveals the specifics of ensuring certain rights of children in the conditions of the armed conflict in Ukraine. The number of children who suffered in Ukraine as a result of the armed aggression of the Russian Federation was analyzed and attention was focused on the issues of guaranteeing children's right to safety, legislative provision of children's right to education, and problematic aspects that arise in the process of implementing this. Right. The peculiarities of placement in family-type children's homes and foster homes for children who were deprived of parental care as a result of the invasion of the Russian Federation into the territory of Ukraine were studied. It was concluded that children and adolescents of the state, as the primary responsible party, are connected with the life and safety of the population. Therefore, there is a need for greater coordination and interaction regarding the needs of children and adolescents during armed conflicts and in post-conflict situations. All parties to an armed conflict must unconditionally fulfill their obligations to protect civilians in general and children in particular by international humanitarian law and prevailing norms of international law.
