Abstract

У дослідженні йдеться про основні міжнародні документи, які визначають права дитини та є своєрідними орієнтирами для цивілізованих країн світу в питанні побудови національного законодавства щодо захисту прав дитини. Зауважується, що Декларація 1959 року визначила основні права та свободи дітей, у свою чергу Конвенція 1989 року встановила перелік прав, обов’язків та гарантій для дітей, що зробило її унікальним інструментом в глобальному контексті. Зазначається, що Декларація прав дитини 1959 року відіграла значну роль у визначенні основних прав дитини. Хоча такі документи не несуть прямих зобов’язань для держав щодо їх дотримання, Декларація стала фундаментом для подальшої діяльності на міжнародному рівні в питанні захисту прав дитини. Конвенція про права дитини визначає стандарти та принципи, які є основою для визнання та захисту прав дітей у всьому світі, встановлюючи міжнародний стандарт у цьому питанні. Акцентується увага на тому, що реалізація прав дитини вимагає систематичного та комплексного підходу, який включає в себе не лише прийняття відповідних нормативно-правових актів, але й створення ефективних механізмів контролю та моніторингу для забезпечення їхнього виконання на практиці. Загальний внесок Декларації та Конвенції у сферу захисту прав дітей визначається регуляцією важливих суспільних відносин. Вони не тільки надають правовий фундамент для захисту дітей, а і є своєрідним орієнтиром для подальших зусиль держав у створенні сприятливого середовища для всебічного розвитку кожної дитини. Також наголошено на важливості та актуальності забезпечення прав дітей в умовах збройних конфліктів, адже діти, які опинилися в зоні збройних конфліктів, часто стають найбільш вразливими категоріями населення.
