Особа потерпілого як елемент криміналістичної характеристики втягнення неповнолітнього в заняття проституцією та сутенерства

Abstract

Досліджено деякі аспекти розслідування втягнення неповнолітнього в заняття проституцією та сутенерства. Розглянуто особу потерпілого як елемент криміналістичної характеристики досліджуваного кримінального правопорушення, а також визначено її характерні ознаки.

The article deals with some aspects of the investigation of involvement of a minor in prostitution and pimping. The person of the victim as an element of forensic characteristics of the investigated criminal offense is considered, as well as its characteristic features is determined. The author notes that the person of the victim is one of the possible elements of the forensic character of the crime. In investigating the involvement of a minor in the occupation of prostitution and pimping, the relevance of the introduction of a specified component to this structure is simply indispensable. This is due to the need to expand the capacity of the investigator to conduct separate investigatory (search) actions and measures. In addition, this element has a stable correlation with other components of the forensic characteristics of the investigated criminal offense, in particular, with the person of the offender, the way of committing the crime, etc. Due to the definition of these links, law enforcement officers will initially be able to put forward relevant versions of the investigation and build a certain sequence of conducting various investigative (search), secret investigation (search) actions and other measures in criminal proceedings. The system of features that characterizes it includes demographic indicators; information about a way of life, features of character, habits, inclinations, connections; signs of victimhood. Among them one can distinguish biological – gender, age, physical development (girls who have an attractive appearance, well developed for their age); social - social roles and status (students and college students living far away from the family); economic (low income); moral and psychological - a tendency to use alcoholic beverages and narcotic substances, an immoral way of life.
