Стягнення заборгованості по аліментах та притягнення боржника до відповідальності за невиконання аліментних обов’язків: проблеми теорії та практики

Abstract

Досліджено порядок стягнення заборгованості по аліментах та умови притягнення боржників до відповідальності за невиконання обов’язків в аліментних зобов’язаннях. Проаналізовано недоліки чинного законодавства стосовно врегулювання проблемних питань у цій сфері та запропоновано можливі шляхи їх вирішення.

Исследованы порядок взыскания задолженности по алиментам и условия привлечения должников к ответственности за неисполнение обязанностей в алиментных обязательствах. Проанализированы недостатки действующего законодательства относительно урегулирования проблемных вопросов в этой сфере и предложены возможные пути их решения.

In the article investigational order of penalty of debt on alimonies and condition of bringing in of debtors to responsibility for the nonperformance of duties in alimentary obligations. A current domestic legislation fixes a duty paternal to retain children in independence from that, or there are they in the registered marriage or in general lives eparately. The methods of implementation of duties to retain a child parents are determined by arrangement between them, or in decision of court. However cases become all more often, when person on that a duty to pay alimonies on a child is fixed, in force of absence of possibility or desire to carry out the duties in general refuses to pay alimonies. In such case penalty of debt on alimonies depends upon the bodies of Government executive service. If a debt folds more than three months, then after the article 71 of the Law of Ukraine «On executive proceedings», penalty it can be convolute on property of debtor. A problem question a decision of property, the proprietor of that is a debtor there can be a convolute penalty on that, is in this case, in our view. To our opinion, to property on that there can be a convolute penalty in matters on the inpayment of debt on alimonies, it follows to take property that belongs to the debt or on the right of general ownership. A current legislation sets also, that for non-fulfillment of duties from the inpayment of alimonies a guilty person can be brought to civil and criminal responsibility. However here also there are certain complications reason of that are in consistencies and contradictions in a current legislation. For this reason it is possible to draw conclusion that a current legislation in the field of it needs further improvement.
