Abstract:
Розкрито вплив війни в Україні на трансформаційні процеси переходу кримінально-
виконавчої системи в пенітенціарну. Виокремлено три стадії трансформаційного процесу:
підготовча, а саме на цій стадії досягається згода громадянського суспільства стосовно базових
цінностей щодо трансформації кримінально-виконавчої системи в пенітенціарну; ухвалення
рішень щодо проведення трансформації кримінально-виконавчої системи в пенітенціарну на
законодавчому рівні; звикання (закріплення), тобто утвердження нових форм і методів
функціонування пенітенціарної системи.
Description:
The article emphasizes that
the current penitentiary system of Ukraine today faces difficult challenges due to the military aggression
of the russian federation against our state. Particularly difficult issues are the functioning of penitentiaries
and remand centers in enemy-occupied territories, such situation does not allow staff of penitentiary
bodies and institutions to be socially protected under Ukrainian law for the period of temporary
occupation.
One of the priorities of the Ministry of Justice of Ukraine was the security of prisoners and staff.
Moreover, when the occupying state began to take aggressive actions to seize power in the penitentiary
institutions of the State Penitentiary Service of Ukraine, since that time there has been a real threat to the
lives and health not only of convicts but also of prison staff.
At the same time, the actual seizure of penitentiary bodies and institutions is accompanied by
intimidation of staff, violence and encouragement of collaborative activities provided for in Article 111-1 of
the Criminal Code of Ukraine. Unfortunately, the events of 2014 did not teach the Ministry of Justice of
Ukraine to act in conditions of war. This is especially true of evacuating convicts and staff to safer places.
There are some explanations for this, because the experience of the functioning of the penitentiary
system of Ukraine during all the years of independence has been constantly in a status of reform and
modernization. Each new head of the department began his work with the preparation of a new concept,
which unfortunately was not completed. Moreover, the historical and legal science evidences that criminal executive system of Ukraine
has passed and continues to pass many vector path of its modernization in different historical periods, and
therefore it does not exclude the possibility of moving forward. It is important that the transformation
processes of the transition from the criminal executive system into the penitentiary system take place on a
legal basis.
There are three stages of the transformation process: preparatory, namely at this stage the
agreement of civil society is reached on the basic values for the transformation of the criminal executive
system into a penitentiary system; decision-making on the transformation of the criminal executive
system into a penitentiary system at the legislative level; habituation (consolidation) is the adoption of
new forms and methods of functioning of the penitentiary system.
The views of the author at the stage of transformation processes of the transition of the criminal
executive system into the penitentiary system of Ukraine are reserched in this article. Because most of the
proposals to reform Ukraine’s criminal executive system remain on paper, thank God they are discussed
at conferences, round tables, symposia, I would like the Ministry of Justice of Ukraine not to ignore the
achievements of domestic scientists, especially in this difficult time for Ukraine.
