Висвітлено дискусійні теоретико-правові аспекти характеристики обов’язку повнолітніх
дітей піклуватися про своїх непрацездатних батьків та винесено для наукового обговорення
авторське трактування такого обов’язку. Обґрунтовано думку щодо недоречності здійснення
характеристики поняття обов’язку повнолітніх дітей піклуватися про своїх непрацездатних батьків
на основі статей 202–206 Сімейного кодексу України, положення яких присвячені характеристиці
обов’язку повнолітніх дочки, сина утримувати батьків. Під час розкриття поняття обов’язку
повнолітніх дітей піклуватися про своїх непрацездатних батьків згадувати про складові інституту
опіки та піклування доречно тільки в аспекті проведення порівняльно-правових досліджень. The article is devoted to identifying the
controversial theoretical and legal aspects of characterizing the duty of adult children to take care of their
incapacitated parents. These characteristics are presented in the article for scholarly discussion of the
author's interpretation of their understanding. Within the framework of the research, the opinion was
substantiated that characterization of the obligation of adult children to take care of their incapacitated
parents should be based on the provisions of Article 172 of the Civil Code of Ukraine «The Duty of Adult
Daughter, Son to Maintain Parents and Its Fulfillment». In this regard, the article emphasizes the need to
discontinue using Articles 202-206 of the Civil Code of Ukraine when defining the duty of adult children
to take care of their incapacitated parents, as these provisions are dedicated to the duty of an adult
daughter or son to maintain parents. The obligations stipulated in Part 1 of Article 172 of the Civil Code
of Ukraine to take care of parents, show concern for them, and provide assistance to them are proposed to
be considered as three different types of obligations. It was established that the collection monetary
penalty by court decision from an adult daughter or son, who does not take care of their incapacitated
parents should be considered as a measure of ensuring compensation for the harm caused by the adult
daughter or son due to non-compliance with the obligation to take care of their incapacitated parents, as
stipulated in Part 1 of Article 172 of the Civil Code of Ukraine, rather than as the imposition of liability.
Also, the article has determined that during the characterization of the obligation of adult children to take
care of their incapacitated parents, as well as the institute of guardianship and care in general, and its
individual components such as «guardian» and «care», it is appropriate to mention those obligations only
in the context of conducting comparative legal research.
