Встановлений порядок управління як об’єкт адміністративно-правової охорони

Abstract

Досліджено сферу публічного управління як об’єкта адміністративно-правової охорони. З’ясовано сутність, визначено правову природу та характерні ознаки встановленого порядку управління. Визначено поняття порядку управління та чинники, що зумовлюють необхідність його адміністративно-правової охорони.

Исследована сфера публичного управления как объект административно-правовой охраны. Выяснена сущность, определены правовая природа и характерные признаки установленного порядка управления. Определено понятие порядка управления и факторы, обусловливающие необходимость его административно-правовой охраны.

The article deals with the study of the field of public administration as an object of administrative and legal protection. The essence is determined, the legal nature and the characteristic features of the established order of management are determined. The order of management covers two large groups of social relations: a) relations that provide conditions for the realization of rights and legitimate interests by individuals in socially significant spheres of public life; b) relations in the course of which the situation of the normal functioning of state authorities, local self-government, civil society institutions, etc. is ensured. The concept of the order of management as regulated by the norms of law and protected by administrative sanctions is determined by the totality (system) of social relations, which are formed during the implementation by external public administration functions of public authorities aimed at ensuring law and order, state, public and personal security. Administrative and legal protection of the management order includes a complex of various organizational and legal, preventive measures carried out by state authorities with the direct participation of citizens and their associations, which are implemented through various forms of control and supervision over the implementation of the current legislation in this area, ensuring order of management, protection of rights and legal interests of subjects of administrative relations, detection and termination of offenses, bringing the perpetrators to administrative liability and realization of administrative-legal and public influence on offenders. The importance of administrative and legal protection of the established order of management is due to: the need to ensure the effectiveness of the functioning of the entire state mechanism; a significant range of relations that are subject to protection; the largest number of offenses located not only in Chapter 15 of the Code of Ukraine on Administrative Offenses, but also in other chapters of the Code; the diversity of the generic object of the attack; a significant number of normative regulations that regulate the relevant sphere of state-management relations, etc.
