Адміністративно-правові засади детінізації відносин у підприємницькій діяльності

Abstract

У дисертації обґрунтовується необхідність та вагоме значення детінізації відносин у підприємницькій діяльності в Україні в сучасних складних соціально-економічних та політико-правових умовах. Досліджуються сутність і види тіньових відносин, фактори зростання рівня тінізації та наслідки її негативного впливу, поняття, принципи, напрями та завдання детінізації відносин у підприємницькій діяльності. Проаналізовано об’єкт і предмет детінізації, визначено склад і уточнено структуру суб’єктів детінізації відносин у підприємницькій діяльності. Охарактеризовано адміністративно-правове регулювання детінізації, його ознаки та особливості, проблеми та перспективи їх розв’язання. Визначено сутність та обґрунтовано значення організаційнометодичного, матеріально-технічного, кадрового та інформаційного забезпечення детінізації відносин у підприємницькій діяльності в Україні. Досліджено форми й методи детінізації відносин у підприємницькій діяльності в Україні. Проаналізовано зарубіжний досвід детінізації відносин у підприємницькій діяльності та можливості його використання в Україні. Запропоновано теоретико-правовий підхід до розробки стратегії детінізації відносин у підприємницькій діяльності в Україні на період 2015-2020 рр. з уточненням її сутності, елементів, особливостей побудови тощо. Надано пропозиції і рекомендації з удосконалення адміністративно-правових засад детінізації відносин у підприємницькій діяльності. This thesis deals with grounding the necessity and importance of the deshadowing relations in business in Ukraine in today's difficult social, economic, political and legal conditions. There is the investigation of essence and types of shadow relations, shadowization growth factors and its negative effects, concepts, principles, guidelines and objectives of the deshadowing relations in business. The object and subject of the deshadowization of relationships in business are analyzed; the composition of deshadowization subjects is defined, and their structure is clarified. The administrative-legal regulation of deshadowization, its features and characteristics, problems and prospects of their solution have been characterized. There are definition of the essence and significance grounding of the organizational methods, logistics, personnel and information support of the deshadowing relations in business in Ukraine. The forms and methods of deshadowing relations have been investigated. The foreign experience of the deshadowization of relationships in business and the possibility of its use in Ukraine have been analyzed. There is a theoretical and legal approach to strategy development of the deshadowing relations in business in Ukraine for the period from 2015 to 2020 with the specification of its essence, elements of construction features and more. The author has made proposals and recommendations to improve the administrative and legal framework of the deshadowing relations in business.
