Суб’єктивні ознаки кримінальних правопорушень у сімейно-побутовій сфері

Abstract

У статті розкрито суб’єктивні ознаки кримінальних правопорушень у сімейно-побутовій сфері, визначено особливості суб’єкта й суб’єктивної сторони. Доведено, що одним з найважливіших структурних елементів складу будь-якого кримінального правопорушення є суб’єктивна сторона. Суб’єктивна сторона складу кримінального правопорушення є внутрішнім проявом суспільно небезпечного діяння, що дає уяву про психічні процеси, які відбуваються у свідомості винної особи під час вчинення правопорушення. Необхідною умовою для притягнення винної особи до кримінальної відповідальності за кримінальне правопорушення в сімейно-побутовій сфері є встановлення відповідних ознак суб’єктивної сторони. Суб’єктивну сторону характеризують дві групи юридичних ознак: обов’язкові й факультативні. До обов’язкових ознак належить вина, до факультативних – мотив та мета. Визначено форми вини, її зміст, мотиви вчинення зазначених кримінальних правопорушень. Охарактеризовано особливості суб’єкта досліджуваного виду кримінальних правопорушень. Окрему увагу надано з’ясуванню ставленню особи до вчиненого діяння та її вплив на кваліфікацію злочину. The article describes the subjective signs of criminal offenses in the family and household sphere, defines the features of the subject and the subjective side. An important element of the composition of any criminal offense is the subjective side. The subjective side of the composition of a criminal offense is an internal manifestation of a socially dangerous act, which gives an idea of the mental processes that occur in the mind of the guilty person during the commission of the offense. A necessary condition for bringing the guilty person to criminal responsibility for a criminal offense in the family and domestic sphere is the establishment of relevant signs of the subjective part. The subjective side contains two groups of legal features: mandatory and optional. Mandatory features include guilt, optional features include motive and purpose. The author defines the forms of guilt, its content, motives for committing the specified criminal offenses. The peculiarities of the subject of the investigated type of criminal offenses are characterized. Particular attention is paid to clarifying the attitude of the person to the committed act and its influence on the assessment of the crime.
