Механізм адміністративно-правового регулювання використання інноваційних технологій у соціальній сфері

Abstract

У статті визначено такі ознаки механізму адміністративно-правового регулювання використання інформаційних технологій у соціальній сфері: його зміст становлять правові, організаційні, технічні засоби впливу; об’єктом впливу є поведінка та інформаційна діяльність органів публічної влади, що забезпечують реалізацію та захист соціальних прав громадян, уповноважені органи у сфері надання соціальних послуг; отримувачі соціальних послуг; надавачі соціальних послуг; об’єднання працівників системи надання соціальних послуг; об’єднання надавачів соціальних послуг; об’єднання отримувачів соціальних послуг; сферою реалізації є сфера інформаційних потреб та інтересів зазначених суб’єктів; засобами є передбачені законодавством у соціальній сфері реєстри, бази даних та інформаційні системи; метою є забезпечення обігу (отримання, зберігання, використання, корегування, передання, знищення) якісної, достовірної, актуальної інформації, що задовольняє інформаційні потреби суб’єктів системи реалізації та захисту соціальних прав громадян. The article defines the following features of the mechanism of administrative and legal regulation of the use of information technologies in the social sphere: its content consists of legal, organizational, and technical means of influence; the object of influence is the behavior and information activity of public authorities that ensure the implementation and protection of social rights of citizens, authorized bodies in the field of providing social services; recipients of social services; social service providers; union of employees of the system of providing social services; association of social service providers; association of recipients of social services; the field of implementation is the field of informational needs and interests of the specified entities; means are registers, databases and information systems provided for by legislation in the social sphere; the goal is to ensure the circulation (receiving, storing, using, correcting, transferring, destroying) of high-quality, reliable, up-todate information that satisfies the informational needs of the subjects of the system of implementation and protection of social rights of citizens. The elements of the mechanism of administrative and legal regulation of the use of information technologies in the social sphere are: entities, namely public authorities that ensure the implementation and protection of social rights of citizens, authorized bodies in the sphere of social services provision; recipients of social services; social service providers; union of employees of the system of providing social services; association of social service providers; association of recipients of social services; informational needs and interests of these subjects, their informational rights and obligations; legal norms; legal facts; information environment; the purpose, tasks, principles of such provision; information and its material carriers; control, supervision of compliance with the rules of information provision of the specified entities and responsibility for violations of relevant legislation. The mechanism of administrative and legal regulation of the use of information technologies in the social sphere as a system of legal, organizational, and technical means of influencing the behavior and activities of public authorities, ensuring the implementation and protection of social rights of citizens, authorized bodies in the field of social services provision, is defined; recipients of social services; social service providers; associations of employees of the system of providing social services, associations of social service providers, associations of recipients of social services and other subjects with whom they interact, in order to ensure the circulation (receiving, storing, using, correcting, transferring, destroying) of high-quality, reliable, up-to-date information that satisfies informational needs and interests in the sphere of implementation and protection of citizens' social rights.
