Участь спеціалістів в огляді місця вчинення воєнних злочинів

Abstract

Розглянуто питання участі спеціалістів різних галузей в огляді місця вчинення воєнного злочину. Встановлено, що це такі спеціалісти: працівники пожежно-рятувальних підрозділів Державної служби з надзвичайних ситуацій, спеціалісти-вибухотехніки/сапери ЗСУ, кінологи зі службово-пошуковими собаками, психологи, спеціалісти-криміналісти, спеціалісти з питань застосування ракетних військ та артилерії, військової авіації, оператори безпілотних літальних апаратів, судово-медичні експерти та ін. Встановлено роль кожного з них у збиранні криміналістично значущої інформації для формування належної кількості доказів у суді. Наголошено на важливості залучення до огляду мобільних ДНК-лабораторій для швидкої ідентифікації тіл чи решток загиблих осіб In view of the statistical data published on the official website of the Office of the Prosecutor General, a very large number of registered violations of the laws and customs of war have been established. Therefore, the article focuses on the need to conduct a qualified inspection of the scene of such types of crimes thanks to the involvement of specialists in various fields of knowledge, taking into account the specific trace pattern, rather large boundaries, a significant amount of destruction and work. It was determined that the following specialists participate in the inspection of the places where war crimes were committed: fire and rescue units of the State Emergency Service (to eliminate the harmful consequences of the event, establish the level of air pollution, etc.), explosives specialists / sappers of the Armed Forces of Ukraine (to determine the category of explosiveness and disposal of explosive devices and substances), a dog trainer with a service search dog (to search for victims, places of detention of prisoners, explosive devices), a psychologist (to provide assistance to victims), forensic specialist (to provide direct technical assistance and work with material evidence), specialist in the use of missile forces and artillery, military aviation (to determine probable directions of attacks, establish the type of weapons, etc.), operator of unmanned aerial vehicles (for aerial reconnaissance, photo- and video recording of the area being examined), a forensic medical expert (for examining a corpse) and others. The role of each of the above-mentioned specialists in collecting forensically significant information for the formation of the appropriate amount of evidence in court has been established. The importance of involving mobile DNA laboratories in the examination for quick identification of bodies or remains of deceased persons was emphasized.
