Нормативно-правові засади введення посиленого варіанту службової діяльності в підрозділах Національної поліції

Abstract

Досліджено основні терміни і поняття, передбачені нормативно-правовими актами, що використовуються науковцями стосовно регулювання умов і порядку несення служби працівниками Національної поліції України у різних режимах, формах, масштабах і способах. Розглянуто, зокрема, поняття та їх співвідношення: службова і службово-бойова діяльність; посилений варіант службової діяльності; повсякденний режим та посилений варіант несення служби; особливий режим несення служби; надзвичайна обстановка; особливі умови діяльності; надзвичайні обставини; екстремальна, ризиконебезпечна та кризова ситуація тощо. З огляду на аналіз основних та додаткових повноважень поліції, передбачених у Законі України «Про Національну поліцію», особливостей виконуваних завдань і специфіки обраних методів для їх реалізації режими несення служби класифіковано на три види: 1) повсякденні службові завдання (виконання планових завдань); 2) спеціальні службові завдання (під час надзвичайного стану чи інших кризових ситуацій); 3) службово-бойові завдання (під час введення воєнного стану).

The article is devoted to the main terms and concepts provided for by normative legal acts and which are used by scientists in relation to the regulation of the conditions and order of service by the employees of the National Police of Ukraine in various modes, forms, scales and methods. In particular, the concepts and their relationship are considered: service and service-combat activity; enhanced variant of official activity; everyday mode and enhanced version of service; special mode of service; emergency situation; special conditions of activity; extraordinary circumstances; extreme, risky and crisis situation, etc. After the full-scale invasion of the russian into Ukraine in February 2022, in connection with the threat to national security, the bodies and units of the National Police as a security force were transferred to maximum combat readiness, which is currently ongoing. «Military» conditions of service in the police have become unclear from the point of view of the order and conditions of their activities, but obviously require specific instructions regarding their involvement in ensuring public safety and order in the demarcation areas near the areas of active hostilities. The acquisition by the police personnel of new «military» functional competencies with the expansion of their powers allows us to talk about a change in the type and mode of service. It is advisable to consider the activities of the security and defense sector in the following legal regimes: 1) peacetime, 2) a crisis situation threatening national security, 3) a special period. Based on the analysis of the main and additional powers of the police provided for in the Law of Ukraine «On the National Police», the specifics of the tasks performed and the specifics of the methods of their implementation, the mode of service is classified into three types: 1) everyday official tasks (fulfillment of planned tasks); 2) special official tasks (during a state of emergency or other crisis situations); 3) service and combat tasks (during the introduction of martial law).
