Медіація в умовах воєнного стану в Україні: сучасність та перспективні напрями дослідження

Abstract

Здійснено загальнотеоретичну характеристику наукових здобутків українських вчених щодо особливостей застосування медіації як альтернативного вирішення конфліктів/спорів у звичайних умовах професійної діяльності та в особливий період у приватно- та публічно-правових сферах життєдіяльності суспільства. Наголошено, що юридичні конфлікти виступають невіддільною складовою життя держави та суспільства. Медіація системно вдосконалюється, зважаючи на теоретичні напрацювання та практичні здобутки вчених і практиків із різних країн. У представленому дослідженні розглянуто незначну частину теоретичних здобутків українських вчених щодо медіації та її ролі в українському суспільстві в умовах воєнного стану. Визначено перспективні наукові напрями дослідження у цій сфері. The article provides a general theoretical description of the scientific achievements of Ukrainian scientists regarding the features of the use of mediation as an alternative solution to conflicts/disputes in ordinary conditions of professional activity and in a special period in the private and public legal spheres of society. It is emphasized that legal conflicts are an integral part of the life of the state and society. Mediation is a widespread mechanism for resolving conflicts in various categories of cases in many countries of the world. This mechanism is systematically improved, taking into account the theoretical developments and practical achievements of scientists and practitioners from different countries. The presented article considers a small part of the theoretical achievements of Ukrainian scientists of martial law once again confirmed its significant role and effectiveness for the legal system of the state. It is emphasized that the restoration and building of harmonious relationships is one of the key goals of mediation. The modern interpretation by scholars of the conflict – through the prism of mediation – as a value that activates its subjects to take certain actions and contributes to the identification of the interests and needs of each participant in this conflict, the adoption of mutually beneficial conditions for overcoming the conflict, the creation of conditions for possible further cooperation, indicates the human-centric foundation of mediation. It is determined that a promising scientific direction, which is entirely applied in nature, is the introduction of the institution of mediation in centers for providing free legal aid in order to resolve the conflict between the victim and a minor suspect accused of committing a criminal offense regarding mediation and its role in martial law. It is noted that mediation as an alternative method of resolving conflicts/disputes obviously has significant advantages, and the introduction of the legal regime
