Деякі особливості досудового розслідування правопорушень, пов’язаних з розкраданням майна на підприємствах металургійної промисловості, вчинених службовими особами

Abstract

У статті досліджено особливості досудового розслідування кримінальних правопорушень, пов’язаних з розкраданням майна на підприємствах металургійної промисловості, що вчиняються службовими особами. Розглянуто ключові методи запобігання таким злочинам та виявлення їх, зокрема негласні слідчі (розшукові) дії. Визначено роль аудіо- та відеоконтролю, спостереження, а також зняття інформації з електронних комунікаційних мереж у процесі розслідування. Акцентовано увагу на важливості дотримання законності, конфіденційності та збереження доказів. Надано практичні рекомендації щодо вдосконалення методів розслідування для запобігання економічним злочинам на підприємствах.The article examines key aspects of pre-trial investigation of criminal offenses related to the theft of property at metallurgical enterprises committed by officials. The author examines in detail the specifics of such crimes, which are characterized by a high level of organization, the use of modern technologies to conceal illegal activities, as well as abuse of official position. It is emphasized that the theft of property at such enterprises has a serious economic and social impact, in particular, it causes significant material losses and undermines trust in the legal system. Particular attention is paid to methods of preventing and detecting these crimes. The paper analyzes covert investigative (search) actions as one of the most effective investigative tools. This concerns the use of audio and video surveillance, which allows obtaining reliable evidence of the involvement of officials in criminal activity. In particular, audio and video recordings record the real actions of suspects, which can be used in court as direct evidence. In addition, the emphasis is on methods of surveillance of persons and objects that allow to detect criminal schemes, including connections between participants in criminal activity and routes of movement of illegally obtained property. The extraction of information from electronic communication networks is considered a powerful tool for tracking the digital trail of criminals, gaining access to their communications, which contain evidence of the planning, coordination and implementation of crimes.The author emphasizes the importance of observing legality and confidentiality during investigative actions. Violation of these principles may lead to the recognition of the collected evidence as invalid in court, which will make it impossible to bring the guilty to justice. The article provides practical recommendations aimed at improving the methods of pre-trial investigation. It is proposed to expand the use of modern technologies in the work of law enforcement agencies, ensure effective interdepartmental coordination and improve the system of professional training of investigators.
