Поняття та зміст механізму адміністративно-правового забезпечення реалізації освітньої функції держави

Abstract

У статті досліджено адміністративно-правове регулювання й забезпечення реалізації освітньої функції держави, визначено поняття й механізм адміністративно-правового регулювання та забезпечення реалізації освітньої функції держави, розкрито їх системоутворювальні елементи. Установлено, що під адміністративно-правовим регулюванням у сфері освіти варто розуміти систему правових норм, що визначають організацію освітнього процесу; права, обов’язки та відповідальність суб’єктів освітнього процесу; форми, методи, засоби та способи публічного адміністрування в галузі освіти, а також напрями реформування освітньої політики держави. Під адміністративно-правовим забезпеченням реалізації освітньої функції держави варто розуміти систему правових норм, принципів, методів, засобів, інститутів, а також організаційноправових заходів, які використовуються державою для регулювання й управління суспільними відносинами у сфері забезпечення доступу громадян до якісної освіти, формування умов для розвитку особистості, підготовки кваліфікованих кадрів, сприяння держави та приватних суб’єктів у розвитку освітньої інфраструктури. Механізм адміністративно-правового забезпечення реалізації освітньої функції держави являє сукупність таких елементів: 1) адміністративно-правових норм, що визначають права й обов’язки учасників освітнього процесу, структуру та функції органів управління освітою, освітні стандарти, процедури ліцензування й акредитації освітніх закладів тощо; 2) принципів адміністративно-правового забезпечення реалізації освітньої функції держави; 3) форм, засобів і способів адміністративно-правового регулювання діяльності суб’єктів реалізації освітньої функції держави, спрямованої на надання освітніх послуг, здійснення адміністративних процедур у сфері освіти, організації, контролю й оцінювання якості надання освітніх послуг; 4) видання актів застосування права – рішень органів публічної адміністрації в результаті реалізації повноважень у сфері публічного адміністрування системою освіти; 5) оскарження (адміністративного, судового) рішень, дій чи бездіяльності учасників освітнього процесу; 6) застосування заходів адміністративної та дисциплінарної відповідальності (до суб’єктів публічної адміністрації) за порушення законодавства у сфері освіти, а також усунення причин та умов, які зумовили настання таких порушень. The article examines administrative and legal regulation and ensuring the implementation of the educational function of the state, defines the concept and mechanism of administrative and legal regulation and ensuring the implementation of the educational function of the state, reveals their system-forming elements. It is established that administrative and legal regulation in the field of education should be understood as a system of legal norms that determine the organization of the educational process; rights, obligations and responsibilities of subjects of the educational process; forms, methods, means and methods of public administration in the field of education, as well as directions for reforming the state’s educational policy. Administrative and legal support for the implementation of the educational function of the state should be understood as a system of legal norms, principles, methods, means, institutions, as well as organizational and legal measures used by the state to regulate and manage public relations in the field of ensuring citizens’ access to quality education, forming conditions for personal development, training qualified personnel, and assisting the state and private entities in the development of educational infrastructure. The mechanism of administrative and legal support for the implementation of the educational function of the state is a set of the following elements: 1) administrative and legal norms that determine the rights and obligations of participants in the educational process, the structure and functions of education management bodies, educational standards, procedures for licensing and accreditation of educational institutions, etc.; 2) principles of administrative and legal support for the implementation of the educational function of the state; 3) forms, means and methods of administrative and legal regulation of the activities of subjects implementing the educational function of the state aimed at providing educational services, implementing administrative procedures in the field of education, organizing, controlling and assessing the quality of providing educational services; 4) issuance of acts of application of law – decisions of public administration bodies as a result of the exercise of powers in the field of public administration of the education system; 5) appeal (administrative, judicial) decisions, actions or inaction of participants in the educational process; 6) application of administrative and disciplinary liability measures (to public administration entities) for violations of legislation in the field of education, as well as elimination of the causes and conditions that led to the occurrence of such violations.
