Межі застосування фізичної сили поліцейськими щодо окремих категорій осіб

Abstract

У статті висвітлено актуальні проблеми визначення меж допустимого застосування фізичної сили поліцейськими щодо окремих категорій осіб, зокрема представників вразливих груп населення, проаналізовано правові підстави, умови та принципи такого поліцейського заходу примусу, а також окреслено критерії пропорційності, необхідності й гуманності під час реалізації поліцейських повноважень. The article highlights current issues in defining the limits of permissible use of physical force by police officers against certain categories of persons, in particular members of vulnerable groups of the population. It analyzes the legal grounds, conditions, and principles of such police coercive measures, and outlines the criteria of proportionality, necessity, and humanity in the exercise of police powers. It is concluded that the decision to use physical force, which method of hand-to-hand combat or struggle, in a particular situation, regarding vulnerable categories of persons, in cases provided for by law, should be made by a law enforcement officer, based on specific circumstances, taking into account the specific physical and psychological properties of the person threatening the protected, rights, benefits, level of threat to the law enforcement officer and/or other persons, should have both a legal basis and a factual basis, and cause minimal harm that is truly necessary and sufficient to achieve the goal of such a measure. When choosing which measure of physical influence to apply to a person, a law enforcement officer should be guided by the constitutionally enshrined principle of the supremacy of human dignity and health.
