Окремі аспекти використання спеціальних знань в процесі розслідування злісного невиконання обов'язків по догляду за дитиною

Abstract

У статті висвітлено окремі аспекти використання спеціальних знань у процесі розслідування злісного невиконання обов’язків по догляду за дитиною. Проаналізовано процесуальні форми залучення фахівців та експертів, їх значення для встановлення об’єктивних обставин кримінального правопорушення. Акцентовано увагу на необхідності чіткого дотримання процесуальних вимог під час отримання, фіксації та використання спеціальних знань. Запропоновано підходи щодо підвищення ефективності взаємодії слідчого зі спеціалістами для забезпечення повного та всебічного розслідування злочинів досліджуваної категорії. На підставі проведеного аналізу визначено перелік найбільш типових судових експертиз, які призначаються під час досудового розслідування. The article is devoted to the analysis of the specific features of using specialized knowledge in the procedural support of investigations into malicious neglect of child care duties. It highlights the significance of involving experts in medical, psychological, pedagogical, psychiatric, and technical fields, which are necessary to establish the objective circumstances of a criminal offense that go beyond the general professional competencies of an investigator. Based on the generalization of investigative practice, the study identifies the most common procedural forms of using specialized knowledge, primarily through the conduct of forensic examinations, with a predominance of forensic medical, forensic psychiatric, and fire-technical investigations. The scope of typical issues addressed by experts in cases of this category is outlined, including determining the causes and timing of bodily injuries, circumstances of death, the mental state of victims and suspects, and technical factors that led to hazardous events. The article also analyzes the practice of involving specialists in specific investigative actions, including corpse examinations and interrogations of minors, where their participation is mandatory. The importance of adhering to procedural requirements during the documentation and application of specialized knowledge is emphasized, as it directly affects the completeness of evidence and the substantiation of investigative conclusions. Recommendations are formulated for improving the interaction between investigators and specialists and enhancing the effectiveness of using specialized knowledge in criminal proceedings related to inadequate child care.
