Оперативно-розшукова протидія наркозлочинності в мережі Інтернет як стратегія протидії наркозлочинності в Україні

Abstract

Надано характеристику незаконного розповсюдження наркотичних засобів, психотропних речовин та прекурсорів через мережу Інтернет. Розглянуто способи вчинення наркозлочинів в мережі Інтернет та їх поділ на типи, способи незаконного використання сучасних технологій накоторговцями. Запропоновано заходи щодо оперативно-розшукової протидії наркозлочинів в мережі Інтернет.

The article outlines the illegal distribution of narcotic drugs, psychotropic substances and precursors through the Internet. The ways of committing drug crimes in the Internet and their division into types, ways of illegal use of modern technologies by drug dealers are considered. The measures on operatively-search counteraction of drug crimes in the Internet are offered. It is noted that the relevance of the study is due to the rapid spread in Ukraine of non-medical use of narcotic drugs and their illicit trafficking through the Internet and the development of an effective system of prevention and operational search for counteracting criminal activities in the electronic resources of the Network. Based on the results of the analysis of practical materials, it is determined that investigators, prosecutors and judges are not yet using the results of operational and investigative activities in the criminal process of proof. The ways of illegal use of modern technologies by drug traffickers are analyzed. It is noted that the main reason for this is that the issue of the use of operational search materials to obtain evidence in the criminal process is not adequately regulated in legislation, developed in theoretical and methodological literature, and therefore it is natural that it has certain difficulties for law enforcement activities, concerns the issue of the use of materials of the UDR of verbal origin in this direction of the criminal process. It is determined that the most widespread type of materials of the ORD of verbal origin used in the interests of criminal proceedings is the communication of a person who is in confidential relations with subdivisions carrying out the ordnance. Attention is drawn to the fact that in most cases information about the circumstances of the crime committed by operational sources can radically affect both the pre-trial investigation process and the trial of the case. Despite this, the issue of development and normative fixing of ways and forms of entering such information into the criminal process becomes especially topical.
