Криміналістична характеристика слідової картини у справах про незаконне заволодіння військовослужбовцем вогнепальною зброєю

Abstract

У статті досліджується слідова картина у кримінальних провадженнях щодо незаконного заволодіння військовослужбовцями вогнепальною зброєю. Автором зазначається, що під час досудового розслідування слідчого цікавить не термінологічне значення досліджуваних об’єктів, а їх змістове наповнення, котре повинно мати сукупність слідів (матеріальних та ідеальних), що були залишення під час вчинення злочину, тому на погляд автора у науковій дискусії більш прийнятним є термін слідова картина а не слідова обстановка. Знання слідової картини як елементу криміналістичної характеристики незаконного заволодіння вогнепальною зброєю має істотне значення під час розслідування цих злочинів, оскільки дозволяє слідчому заповнювати пробіли малоінформативної слідової картини на початковому етапі розслідування. Слідова картина відіграє важливу роль і набуває особливого значення, коли між нею і іншими елементами криміналістичної характеристики виявляються кореляційні зв’язки, які дозволяють прогнозувати наявність невідомих елементів при наявності низки відомих.
