| Abstract: | Досліджено деякі аспекти криміналістичної характеристики втягнення неповнолітніх у протиправну діяльність. Розглянуто спосіб вчинення кримінального правопорушення як елемент криміналістичної характеристики вказаного протиправного діяння, а також зв’язок з іншими елементами. Розглянуто погляди вчених щодо формулювання та трактування вказаного елемента криміналістичної характеристики стосовно як протиправної (злочинної) діяльності загалом, так і окремих видів кримінальних правопорушень. Визначено основні способи втягнення неповнолітніх у протиправну діяльність, зокрема: використання або погроза використання фізичного насильства (побиття, завдання тілесних ушкоджень); психічний примус (погроза завдати матеріальних збитків, зганьбити в очах однолітків та товаришів, залякування); зловживання особою матеріальною або іншою залежністю від неї неповнолітнього; компрометація чи шантажування (погроза видати компрометуючу інформацію інтимного чи особистісного характеру); обіцянка винагороди за вчинене протиправне діяння; розпалювання низьких почуттів (помсти, заздрості). |
| Description: | The article examines some aspects of the forensic characteristics of the involvement of minors in illegal activities. The method of committing a criminal offense is considered as an element of the forensic characterization of the specified illegal act, as well as the connection with other elements. The views of scientists on the formulation and interpretation of this element of forensic characteristics in relation to both illegal (criminal) activities and certain types of criminal offenses are considered. On the basis of research of judicial and investigative practice the basic ways of involvement of minors in illegal activity are defined, in particular: – use or threat of use of physical violence (beating, infliction of bodily harm); – mental coercion (threat of material damage, disgrace in the eyes of peers and comrades, intimidation); – abuse of material or other dependence of a minor; – compromising or blackmailing (threat to disclose compromising information of an intimate or personal nature); – promise of reward for the committed illegal act; – incitement of low feelings (revenge, envy). As a result, it is noted that the method of involving minors in illegal activities consists of a number of interrelated elements, which together serve to more effectively conduct certain procedural actions. Noting the above, it is emphasized that the ways of involving minors in illegal activities are an important element of forensic characterization, due to which it is possible to build tactics for individual SRD, NSRD and other procedural actions. This component is important for understanding the research category. |
