Legal regulation of the activities of the National Police of Ukraine regarding the prevention of domestic violence

Abstract

Метою дослідження є превентивна діяльність Національної поліції України щодо протидії домашньому насильству за нинішнього сценарію. У статті проаналізовано основні нормативно-правові акти України, які регулюють вжиття невідкладних заходів щодо запобігання та протидії насильству в сім’ї, гендерно зумовленому насильству, захисту прав осіб, які постраждали від такого насильства. Основними завданнями та методами роботи підрозділів превентивної роботи Національної поліції України є: виявлення фактів домашнього насильства та своєчасне реагування на них; прийом та розгляд заяв і повідомлень про домашнє насильство, у тому числі розгляд повідомлень, що надійшли до колцентру з питань запобігання та протидії домашньому насильству, ґендерно зумовленому насильству та насильству над дітьми тощо. Методологічною основою дослідження є порівняльно- правовий та системний аналіз, формально-юридичний метод, метод інтерпретації, герменевтичний метод, а також методи аналізу та синтезу. Висновки. Визначено, що законодавство України у сфері протидії та запобігання домашньому насильству включає законодавчі та підзаконні, відомчі та нормативно-правові акти. Зазначається, що підрозділи Національної поліції України здійснюють повноваження у сфері запобігання та протидії домашньому насильству з урахуванням міжнародних стандартів реагування правоохоронних органів на випадки домашнього насильства та оцінки ризиків. Конкретизовано загальні та спеціальні заходи, які застосовуються до кривдників, а також зазначено особливості їх застосування превентивними підрозділами Національної поліції України у сфері запобігання та протидії домашньому насильству. The purpose of the research is preventive activities of the National Police of Ukraine to counteract domestic violence under the current scenario. Main content. The article analyzes the main regulatory legal acts of Ukraine that regulate the adoption of urgent measures to prevent and counteract domestic violence, gender-based violence, and protect the rights of persons affected by such violence. The main tasks and methods of the preventive units of the National Police of Ukraine include: identification of facts of domestic violence and timely response to them; receiving and reviewing applications and reports of domestic violence, including consideration of reports received by the call center for preventing and countering domestic violence, gender-based violence and violence against children, etc. Methodology: The methodological basis of the research is presented as comparative-legal and systematic analysis, formallegal method, interpretation method, hermeneutic method as well as methods of analysis and synthesis. Conclusions. It is determined that the legislation of Ukraine in the field of countering and preventing domestic violence includes legislative and bylaws, departmental, and regulatory legal acts. It is noted that units of the National Police of Ukraine exercise powers in the field of preventing and countering domestic violence, taking into account international standards for the response of law enforcement agencies to cases of domestic violence and risk assessment. The general and special measures applied to abusers are specified, as well as the specifics of their application by the preventive units of the National Police of Ukraine in the field of preventing and countering domestic violence are indicated.
